BACKGROUND:  A claim has been filed by O G & E in the amount of $3,323.02 for damages incurred to a pole located at 215 East Constitution on March 28, 2014, when a sanitation truck struck the pole.
 
DISCUSSION: This incident was investigated by Gary Seal, Acting Utilities Superintendent. During the investigation, Mr. Seal determined that the driver was backing away from a dumpster at 205 E. Constitution Street and misjudged the distance and clearance between the collection truck and utility pole.  As a result, the driver struck the utility pole and knocked it down.  
 
It appears there could be possible negligence on the part of the City in this matter and staff recommends payment of this claim. The damages reported by O G & E appear to be reasonable.
 
RECOMMENDATION:  Based upon the above and foregoing, it is the recommendation of the City Attorney's office that the claim of O G & E in the amount of $3,323.02, as set forth above, be approved.
