BACKGROUND: The final plat for subject addition was filed of record on October 15, 2009. Within the final plat, public utility and drainage easements were dedicated for a sanitary sewer system and storm water system to serve the properties. The location is approximately 840-feet northwest of 24th Avenue N.W. on the south side of Conference Drive.
DISCUSSION: Since the final plat was filed of record, the owners have succeeded in developing three junior tenant buildings adjacent to Academy Sports. However, during design, a conflict between the north building and existing public utilities was discovered. The only utilities within the easements are sanitary sewer and storm water pipelines owned by the City of Norman. The owners hired a professional engineer to design and submit construction plans for relocation of the sanitary sewer and storm water pipelines. The construction plans have been approved for the relocation of these utilities and storm water systems. The attorney for the owners has submitted new easement dedication documents for the relocated sanitary sewer and storm water pipelines. All the franchised utility companies were notified to assess the impact of their facilities with the requested closure. No objections were presented by the franchised utility companies. Planning Commission, at its meeting of September 13, 2012, recommended adoption of this ordinance.
