CONSIDERATION OF THE DECLARATION OF TWENTY-FIVE (25) USED BODY ARMOR PANELS FROM THE POLICE DEPARTMENT AS SURPLUS AND/OR OBSOLETE AND AUTHORIZATION OF THE DONATION THEREOF TO THE CLEVELAND COUNTY SHERIFF'S OFFICE AND THE COUNCIL ON LAW ENFORCEMENT EDUCATION AND TRAINING (CLEET).

BACKGROUND:  The Norman Police Department provides body armor panels to every commissioned police officer, which is replaced every five years based on industry recommendations and union contract.  The used body armor panels are generally destroyed or used for ballistic testing.  
 
DISCUSSION:  Recently, there have been requests from the Cleveland County Sheriff's Office and the Council on Law Enforcement Education and Training (CLEET) to donate any used body armor panels.  After some evaluation, these agencies would re-issue any of the items that had working life left to law enforcement officers who cannot afford to purchase them.  Section 8-301 of the code of the City of Norman provides that "The City Council must declare surplus or obsolete any supplies, materials, or equipment where the valuation exceeds one thousand dollars ($1,000.00) prior to the selling of such supplies, materials, or equipment.
 
The Norman Police Department currently has twenty-five (25) used body armor panels to donate to law enforcement agencies.  The current value for the used body armor panels is $100.00 each or $2,500 for all twenty-five (25).  
 
The City Attorney's Office has no objections to the donation and suggested the use of "Liability Waiver" form, which would be signed by a representative of any agency upon receipt.
 
RECOMMENDATION:  It is recommended the twenty-five (25) used body armor panels be declared surplus and that the donation to law enforcement agencies be approved.
