EASEMENT NO. E-1213-9: CONSIDERATION OF ACCEPTANCE OF A PERMANENT SIDEWALK EASEMENT DONATED BY CHARLES JAMES COLEMAN FOR THE CITY OF NORMAN FYE 2013 CONCRETE PROJECT.

BACKGROUND: The FYE 2013 Budget allocates capital funds to construct sidewalks in five locations. One of these locations is not platted with only 33 feet of statutory right-of-way on the four-lane roadway. This project requires an additional 17 feet of easement adjacent to the property at 535 48th Avenue N.W. to construct a sidewalk. The adjacent properties to the north and south are platted with 50 feet of right-of-way.
DISCUSSION: The property owner has donated the easement on the condition that the following items are achieved:
1. Construction of a 5’ wide sidewalk connecting and matching the existing sidewalk to the north and south ends adjacent to the easement.
2. Rebuild the driveway approach and approximately 25’ beyond the sidewalk to provide a sidewalk intersection that meets ADA requirements and driveway grades at the approach and beyond the sidewalk that prevents dragging of a vehicle undercarriage and appurtenances.
3. Leave all existing trees in place, but may trim limbs to provide appropriate access under branches.
4. Grade the soil adjacent to the sidewalk and driveway to provide gradual slopes and replace damaged grass with sod in a manner to provide erosion control to match or improve existing conditions.
5. Provide a retaining wall along the east edge of the sidewalk where needed no more than 2’ foot in height to accommodate steep slopes.
6. Land owner shall bear no costs, expense, or liability in connection with this project and City agrees to hold landowner harmless.
