CONTRACT NO. K-1213-166:  AN ENCROACHMENT AGREEMENT BY AND BETWEEN THE CITY OF NORMAN, OKLAHOMA, AND PHILLIPS 66 PIPELINE, L.L.C. FOR THE REPLACEMENT OF A WATER LINE NEAR APPLE CREEK APARTMENTS IN PRAIRIE CREEK ADDITION.

BACKGROUND:  Capital project No. WA0049 provides for replacement of about 2,800 feet of ductile iron (DI) water line main with C900 PVC in the Apple Creek Apartment area of Prairie Creek Addition.  The D.I. pipe is not compatible with the acidic soil and is failing, causing extensive damage to driveways, streets, and yards.  On August 25, 2009, NUA approved Contract K-0910-62 with Cardinal Engineering for on-call engineering and drafting services and Contract K-0910-55 with Lemke Land Surveying for on-call surveying .  The Apple Creek project is the type of basic engineering work that the on-call contracts are meant to address. The waterline replacement design was performed by staff with the assistance of Cardinal Engineering and Lemke Land Surveying.
 
DESCRIPTION:  The waterline is being realigned and, as a result, crosses a Phillips 66 Pipeline in three locations.  Phillips 66 requires a signed Encroachment Agreement for the installation of the waterline within their easement. The new waterline is proposed to be encased in coated steel conduit for the protection of both the waterline and the Phillips pipeline.
 
RECOMMENDATION:  Staff recommends that the NUA authorize the chairman to sign the encroachment agreement with Phillips 66 Pipeline LLC.
