BACKGROUNDThe final plat for Highland Village Addition Section 8 was approved by City Council on April 23, 2015 and was filed of record on April 28, 2015 with the Cleveland County Clerk. The plat consists of 39 residential lots and 1 open space lot located just west of Porter Avenue and south of Tecumseh Road.  The property owners have donated an easement for a public sidewalk located outside of the right-of-way and on private property at 3208 Terrace Park Trail.

 

DISCUSSIONPublic sidewalk improvements have been installed as part of the home construction.  To meet the sidewalk width requirements and avoid a sanitary sewer manhole, a portion of the public sidewalk was placed on private property necessitating the need for an additional public sidewalk easement.  The City Attorney’s Office has reviewed the easements as to form.

 

RECOMMENDATIONBased upon the above information, it is the recommendation of staff that Easement E-1617-6 for public sidewalks be accepted.
