SPECIAL CLAIM SC-1516-1: A CLAIM IN THE AMOUNT OF $3,712.37 SUBMITTED BY FOWLER VOLKSWAGON FOR DAMAGES INCURRED TO A VEHICLE OWNED BY THE DEALERSHIP THAT WAS STRUCK BY A SANITATION TRUCK WHILE PARKED AT COLLISION WORKS LOCATED AT 531 HIGHLAND PARKWAY.

BACKGROUND: A claim has been filed by Fowler Volkswagen in the amount of $3,712.37 for damages to a 2014 Volkswagen Jetta SE which was owned by the dealership. These damages occurred on May 20, 2015, when a City of Norman sanitation truck hit the vehicle which was parked at Collision Works at 531 Highland Parkway following repairs.
DISCUSSION: This claim was investigated by Bret Scovill, Utilities Manager. According to his investigation, a City sanitation crew was in the parking area at Collision Works performing their weekly sanitation pickup. When the City sanitation truck pulled forward to turn right, the truck caught the front end of the vehicle with the rear wheels on the truck.
As indicated above, there appears to be possible negligence on the part of the City in this matter and, consequently, potential liability on the City. The amount claimed by Fowler Volkswagen in the amount of $3,712.37 appears reasonable.
RECOMMENDATION: Based upon the above and foregoing, it is the recommendation of the City Attorney’s office that the claim of Fowler Volkswagen in the amount of $3,712.37 be paid.
