EASEMENT NO. E-1314-19: CONSIDERATION OF ACCEPTANCE OF A DRAINAGE EASEMENT DONATED BY NORMAN (PORTER) DOP VIII, L.L.C., TO BE USED FOR STORM WATER IMPROVEMENTS WITHIN WOODCREST ESTATES PLAZA ADDITION, LOT 2, BLOCK 2.

BACKGROUND: The final plat for Woodcrest Estates Plaza Addition was filed of record with the Cleveland County Clerk on March 25, 1970. The property consists of .98 acres and is located at the northeast corner of Porter Avenue and Woodcrest Drive. The property has remained vacant since the filing of the final plat until the City Council, at its meeting of January 22, 2013, adopted Ordinance No. O-1213-24 placing this property in C-1, Local Commercial and removing it from RM-6, Medium Density Apartment District. The owners, Norman DOP VIII, LLC, submitted a building permit application on February 28, 2013 to construct a Dollar General Store on the property. Storm water detention facilities were proposed and constructed. Per City regulations, detention facilities must be located within a drainage easement. The recording of this easement meets this requirement.
DISCUSSION: Based upon the fact there is a need for storm water improvements within the development and the developer/owner is willing to provide a drainage easement, staff recommends acceptance of Easement No. E-1314-19. The maintenance responsibility for these improvements is borne by the property owner.
RECOMMENDATION: Staff recommends that Easement No. E-1314-19 be accepted and the filing thereof be directed.
