BACKGROUND: A claim was filed by Scissortail Travel Stop, LLC, in the amount of $3,152 for damage to an air conditioner unit on February 24, 2020, at 1161 12th Avenue Northeast.
DISCUSSION: This incident was investigated by Stan West, Utilities Supervisor. On February 24, 2020, a Sanitation Department trash truck driver was servicing a dumpster at Scissortail Travel Stop located at 1161 12th Avenue Northeast. During this service, the driver set down the dumpster but he was unable to see a crate was laying on the ground directly behind where the dumpster was placed. The driver then attempted to reposition the dumpster by pushing it backward but this also pushed the crate back and into the air conditioning unit directly behind the crate. The air conditioning unit was subsequently damaged by this action.
Scissortail Travel Stop, LLC, provided estimates to replace the air conditioning unit with the lowest estimate being $3,152. As indicated above, there appears to be possible negligence on the part of the City in this matter and consequently potential liability on the City. The claim from Scissortail Travel Stop, LLC, in the amount of $3,152 appears reasonable.
RECOMMENDATION: Based upon the above and foregoing, it is the recommendation of the City Attorney’s office that the claim of Scissortail Travel Stop, LLC, in the amount of $3,152 as set forth above, be approved.
