MEDICAL PARK WEST SECTION 4, NORMAN, CLEVELAND COUNTY, OKLAHOMA; AND PROVIDING FOR THE SEVERABILITY THEREOF.

BACKGROUND: This is a request for closing parts of existing platted utility easements and providing new described legal descriptions for replacement easements within the documentation provided for Lot 17A, Block 4, N.R.H. Medical Park Addition, Section 4, a Planned Unit Development filed of record on May 5, 2010. Lot Line Adjustment No. 1532 changed the legal description for Lot 17A and was filed of record August 18, 2015.

DISCUSSION: All franchised utilities were notified to assess the impact on their facilities with the closure of easements; there were no objections. However, the City of Norman has an existing utility within the easement. Currently, a sanitary sewer main is located in the respective easements. The owners hired a professional engineer to design and submit plans for the relocation of the public sanitary sewer main. The construction plans have been reviewed. The relocation of the sanitary sewer main has been installed. The attorney for the owners has submitted separate instrument easements that will cover the proposed sanitary sewer main and any utilities. Planning Commission, at its meeting of September 8, 2016 meeting recommended adoption.

RECOMMENDATION: The platted easements were specifically designed to serve the NRH Medical Park Additions. With the relocation of the public sanitary sewer improvements, staff recommends approval of the request for partial closure of utility easements and ultimately vacate that portion of easements that is in conflict with the proposed building and accept the new separate instrument easements for the sanitary sewer that have been submitted by the attorney for the owner as p...
