EASEMENT E-1617-49:  CONSIDERATION OF ACCEPTANCE OF A PERMANENT PUBLIC ACCESS EASEMENT DONATED BY JOHNSON CONTROLS D/B/A YORK-LUXAIRE, INC., FOR WATER WELL #16.

BACKGROUND:  Johnson Controls dba York-Luxaire, Inc. recently expanded their facilities located at I-35 and Franklin Road.  The expansion affected the City’s Water Well #16 due to its close proximity of construction.  No records of pre-existing easements were shown for the well or water line.  The well has been there since 1953 so Johnson Controls worked with staff to establish an easement for well access and an easement for the water line as well as the water well and well house.

 

DISCUSSION:  Easement E-1617-49 is a public access easement for the drive access into Well #16 and there will be a second public utility easement for the water line to the well house for water well #16.  Though the well is currently not in use due to high arsenic concentrations, future blending or treatment is being sought to return this well to service.    Staff requests City Council acceptance of the donated 25 foot to 20 foot access easement donated by York-Luxaire, Inc.:

 

RECOMMENDATION:  Staff recommends that the City of Norman accept the Easement E-1617-49.
