SPECIAL CLAIM SC-1718-6: SUBMITTED BY VINCENT AND CAROLYN PETERS IN THE AMOUNT OF $2,680 FOR DAMAGES TO THEIR VEHICLE AS A RESULT OF AN ACCIDENT WITH A PARKS DEPARTMENT VEHICLE AT THE INTERSECTION OF NORTH UNIVERSITY BOULEVARD AND WEST MAIN STREET.

BACKGROUND: A claim was filed by Vincent and Carolyn Peters in the amount of $2,680 for damage their vehicle received on July 19, 2017, when it was struck by a City of Norman Parks Department trailer at the intersection of West Main Street and North University Boulevard.
DISCUSSION: This incident was investigated by Matt Hendren, Parks Superintendent, and it was found that on July 19, 2017, a City Parks employee was driving a City owned pick-up truck with a trailer headed northbound on University Boulevard. The employee then came to a stop for a red traffic signal at Main Street but had pulled into the far left lane to allow for a wide right turn to head eastbound on Main Street. Unbeknownst to the employee, Ms. Peters also approached the intersection in her vehicle and came to a stop in the right turn lane immediately to the right of the employee. As the signal turned green, the employee pulled into the intersection and turned right, causing the middle right side of the trailer to strike Ms. Peters’ 2008 GMC Envoy, which sustained damage to the front bumper, left side tire, fender, headlamp assembly and rear view mirror.
The Claimants have submitted three (3) estimates for repair and the lowest estimate is for $2,680.28. As indicated above, there appears to be possible negligence on the part of the City in this matter and, consequently, potential liability on the City. Claimants’ request, in the amount of $2,680, appears reasonable.
RECOMMENDATION: Based upon the above and foregoing, it is the recommendation of the City Attorney’s office that the claim of Vincent and Carolyn Peters, in the amount of $2,680 as set forth above, be approved.
