SPECIAL CLAIM SC-1516-5: A CLAIM IN THE NEGOTIATED AMOUNT OF $2,137.06 SUBMITTED BY HEATHER HAHN FOR DAMAGES TO HER VEHICLE DUE TO AN ACCIDENT WITH A SANITATION VEHICLE IN THE ALLEY BEHIND 111 NORTH PETERS AVENUE.

BACKGROUND: A claim has been filed by Heather Hahn in the amount of $2,250.84 for damages to her vehicle due to a vehicle accident occurring on November 4, 2015, when her vehicle was struck by a City of Norman sanitation truck in the alley at 111 N. Peters.
DISCUSSION: This incident was investigated by Terry Richmond, Utilities Supervisor. Mr. Richmond confirmed that the sanitation truck was in the alley at 111 N. Peters on November 4, 2015. After emptying a commercial dumpster at that location, the driver noticed a low-hanging powerline and was concerned that there was not enough clearance. At that time, the driver of the sanitation truck backed up in order to clear the low-hanging line and was unable to see Ms. Hahn’s vehicle in his mirrors since her vehicle was very close to the truck.
Ms. Hahn obtained three estimates regarding the damage to her vehicle with the lowest estimate being $2,137.06. While Ms. Hahn’s claim requested a higher amount, due to her preference of body shops, she has agreed to accept the lowest estimate in the amount of $2,137.06.
It appears there could be possible negligence on the part of the City in this matter and staff recommends payment of this claim in the amount of $2,137.06.
RECOMMENDATION: Based upon the above and foregoing, it is the recommendation of the City Attorney’s office that Ms. Hahn’s claim in the agreed settlement amount of $2,137.06, as set forth above, be approved.
