CONTRACT NO. K-1415-40: A CONTRACT BY AND BETWEEN THE NORMAN UTILITIES AUTHORITY AND TERRACON CONSULTANTS, INC. IN AN AMOUNT NOT-TO-EXCEED $100,000 FOR CONSTRUCTION QUALITY ASSURANCE TESTING SERVICES DURING THE PHASE 2 WATER RECLAMATION FACILITY IMPROVEMENTS.

BACKGROUND: On April 22, 2014, the Norman Utilities Authority (NUA) approved Contract No. K-1314-136 with Archer Western Construction, LLC (Archer Western) in the amount of $48,822,550 for construction of the Water Reclamation Facility (WRF) Phase 2 Improvements. The work began June 2, 2014 and the project is expected to be complete by November 18, 2016.
As the prime construction contractor for the project, Archer Western will supply materials, equipment and labor to construct the improvements. Construction quality assurance (CQA) testing by an independent consulting firm is performed to ensure that the improvements comply with the contract documents and will perform as intended throughout its design life. Funding for the independent consulting firm was included in the original project budget.
DISCUSSION: Attached Request for Proposal (RFP)-1314-68 was issued on June 23, 2014 and forwarded to local geotechnical consultants; proposals were received from two consultants on June 30, 2014. Staff ranked the proposals in accordance with the RFP criteria and selected Terracon Consultants, Inc. as submitting the best proposal. The proposed contract generally includes construction quality assurance testing to ensure the construction contractor will: (1) provide rock, gravel and other materials meeting the contract specifications; (2) properly compact soils and rock within pipeline trenches, and beneath and adjacent to new structures or paving; and (3) supply concrete and asphalt meeting the requirements of the contract specifications for durability and strength.
The attached contract defines the scope of work and sets forth the unit prices for the various quality assurance testing that may be provided. Based on testing frequencies included in the contract documents, staff recommends that a not-to-exceed contract amount of $100,000 be established for the 30-month project duration.
59% of the WRF Phase 2 Improvements are attributed as "Current Obligations" and are funded by the Water Reclamation Fund and 41% of the improvements are attributed as "Future Obligations" and are funded by the Sewer Excise Tax (SET). At this time, the Fiscal Year Ending (FYE) 2015 budget includes unencumbered Construction funding of $1,437,787 in Water Reclamation Fund account 032-9048-432.61-01 (WW0065) and $986,728 in SET account 322-9048-432.61-01 (WW0065); $59,000 from the Water Reclamation Fund and $41,000 from the SET will be utilized for this work.
RECOMMENDATION: Staff recommends approval of the unit price contract with Terracon Consultants, Inc., with a maximum not to exceed amount of $100,000. Funding will be an estimated $59,000 from Water Reclamation Fund Construction (account 032-9048-432.61-01; project WW0065) and $41,000 from the Sewer Excise Tax (account 322-9048-432.61-01; project WW0065).
