CONTRACT K-1920-81: A CONTRACT BY AND BETWEEN THE CITY OF NORMAN, OKLAHOMA, AND CROSSING THE CHASM, LLC, TO PROVIDE INDEPENDENT PROFESSIONAL CONSULTATION SERVICES RELATED TO THE AMERICANS WITH DISABILITIES ACT (ADA) COMPLIANCE EFFORTS OF THE CITY OF NORMAN, FROM OCTOBER 22, 2019, THROUGH JUNE 30, 2020.

BACKGROUND:  On June 26, 2018, City Council adopted the 2018 Americans with Disabilities Act (ADA) Transition Plan via Resolution R-1718-110.  The City’s Director of Public Works currently serves as the City’s ADA Coordinator.  One of the recommendations contained in the 2018 ADA Transition Plan was to consider hiring a full-time ADA Coordinator with specific expertise in the knowledge and implementation of the ADA requirements.

 

On February 12, 2019, City Council approved Contract K-1819-102 with Crossing the Chasm, LLC, (Consultant) to provide for independent professional consultation services, including the consultant’s service as the City’s ADA Technician.  On September 5, 2019, Consultant provided written notice of early termination of Contract K-1819-102, in compliance with the provisions of that contract, and Consultant’s last day of services under that agreement was October 4, 2019.  Although Consultant is no longer able to serve as the City’s ADA Technician, Consultant is willing to continue providing independent professional consultation services to the City as needed in accordance with a separate fee schedule attached as Exhibit A. 

 

DISCUSSION:  If approved, this new agreement will be effective from October 22, 2019, though June 30, 2020, and is renewable subject to sufficient funding by City Council.  Payment for services shall be made in accordance with the fee structure attached as Exhibit A.  The agreement provides that any amendment to the fee structure would require an amendment approved by City Council.

 

Contract K-1920-81 provides that Consultant will provide independent ADA-related professional consultation services, including but not limited to, conducting trainings, leading meetings, and other ADA-related professional services as needed, in accordance with the attached rate schedule.

 

Funds are available in Consultants/Other (Account 010-5001-430.40-09).

 

RECOMMENDATION:  Staff recommends that City Council approve Contract K-1920-81 with Crossing the Chasm, LLC.
