BACKGROUND:  This item is a final plat for Legacy Park, University North Park Addition, Section IX, a Planned Unit Development and is generally located on the west side of 24th Avenue NW and Legacy Park Drive.  This plat consists of 15.755 acres including two (2) commercial lots zoned as a Planned Unit Development and one (1) Park Land lot (Legacy Park).  The park land consists of 7.73. Lot 1 consists of 2.87 acres and Lot 3 consists of 1.89 acres.  The final site development plan indicates Lot 1, Block 1 as possible restaurants and/or retail, Lot 2, Block 1, as City Park Land and Lot 3, Block 1 as possible restaurants and/or retail.
 
Planning Commission, at its meeting of July 12, 2012, approved the final plat for University North Park Addition, Section IX, a Planned Unit Development.
 
DISCUSSION:  The public improvements consist of storm drainage, streets and sidewalks.  A portion of the public improvements will be made by the NTIFA in conjunction with the construction of Legacy Park, and a portion of the public improvements will be made by the developer in conjunction with the restaurant pad sites.  To ensure timely construction of Legacy Park with a projected opening date in November of 2013, it is anticipated the developer will ensure its portion of the public improvements by posting a letter of credit for concurrent construction to allow the final plat to be filed as quickly as possible.  Once the final plat is filed and final review of the bid specifications is completed, construction of Legacy Park can be bid with an award of the construction contract coming to Council in September.  Waterlines and fire hydrants are existing and were verified by a field inspection.
 
As stated in the Planning Commission staff report of July 12, 2012, the northern leg of Legacy Park Drive is being proposed as a public street.  The southern portion of Legacy Park Drive was previously platted as a private street in University North Park, Section 1.  As plans for Legacy Park have developed in recent years, staff and the developer have concluded that Legacy Park Drive would function better as a public street.  It is staff's opinion the southern leg of Legacy Park Drive should now be dedicated as a public street.  Staff is currently coordinating with the owner of that portion of the street to seek a donated right-of-way for the southern portion of the public street, including storm drainage and utilities.  If that property owner is not willing to donate the right-of-way, the southern leg of Legacy Park Drive will be changed on the final plat to a private road easement prior to recording of the plat.
 
RECOMMENDATION:  Based upon the above information, staff recommends acceptance of the public dedications contained therein.  If the final plat is approved, the City Development Committee will then ensure completion of all required public improvements or will approve the construction of the public improvements concurrently with construction on the lots provided the public improvements required by the private portion of the development is bonded in accordance with City Code provisions.  Once the completion of the public improvements is secured, then the Development Committee will recommend that the Mayor sign the final plat and then proceed with its filing.
