CONSIDERATION OF AUTHORIZATION FOR THE PURCHASE OF AN OUTDOOR WARNING SIREN FROM SAFETYCOM IN THE AMOUNT OF $42,398.50 FOR THE FIRE DEPARTMENT AND BUDGET APPROPRIATION FROM RISK MANAGEMENT REVENUE ACCOUNT AND BUDGET TRANSFER FROM A PROJECT ACCOUNT.

BACKGROUND: On or about September 10, 2015, Cleveland County, Oklahoma, road maintenance crews were performing work on behalf of the City of Norman along Bethel Road and NE 144th Street. While grading the shoulder of the road a grader driver backed over and destroyed the outdoor warning siren originally installed in December 2010. The cost to the City of replacing this siren from Safetycom, Inc. is $42,398.50.
DISCUSSION: A claim was made to Cleveland County for the replacement of the destroyed outdoor warning siren. OneBeacon Government Risks, the County’s insurance company, reviewed the claim and accepted responsibility on behalf of the County. The County’s insurance company offered to settle the claim for $36,959.70, after considering the life of the siren/pole, the solar power system, radio transmitter and the batteries, adjusting the value after depreciation, and included installation and shipping.
The City Council approved the settlement amount in the meeting on June 28, 2016, and directed that the $36,959.70 check be deposited into the Miscellaneous Risk Management Revenue Account (043-0000-367.12-64). This check was received and deposited accordingly in June 2016.
The difference between the depreciated value of the damaged warning siren and the new warning siren to be purchased ($5,438.30) is proposed to be transferred from remaining funding from the City of Norman Combined Purpose General Obligation Bonds, Series 2010 (authorized by Ordinance O-1011-3) which was originally used to replace the City’s outdoor warning system (storm sirens).
Safetycom, Inc. is a sole source vendor for this siren in order to maintain the functionality of the system software.
RECOMMENDATION: Section 8-204(b)(2) of the Code of the City of Norman authorizes the City Council to waive competitive bidding for the purchase of supplies, materials, equipment, or contractual services which can be furnished only by a single dealer or which have a uniform price wherever bought. In accordance therewith, it is recommended that City Council approve the purchase of a replacement siren from Safetycom in the amount of $42,398.50.
It is further recommended that $36,959.70 be appropriated from Risk Management Fund Balance (043-0000-253.20-00) and $5,438.80 be transferred from Outdoor Warning System, Construction (050-9386-419.61-01; project BP0313) to Fire Department Disaster Preparedness Radio/Communication Equipment/Other (010-6444-422.54-99).
