BACKGROUNDOn May 22, 2019, the Governor of Oklahoma designated the City to be the direct recipient of federal funds to be used for the provision of public transportation services effective upon the date the Federal Transit Administration (FTA) formally approves the City eligible to receive such federal funds. On June 20, 2019, the FTA formally designated the City to be the direct recipient of such federal public transportation funds.

 

Beginning July 1, 2019, the City of Norman officially became the operator of transit in Norman. This included fixed-route public transit and the federally mandated complementary Americans with Disabilities Act (ADA) paratransit service.  After operating the paratransit service for several months, the City and EMBARK have identified a need to acquire additional vehicles to ensure a reasonable balance between meeting daily demand and providing acceptable fleet maintenance.

 

DISCUSSION:  The Central Oklahoma Transportation and Parking Authority d/b/a EMBARK, an FTA grantee and the City’s contracted transit operator, has a paratransit vehicle that has reached its useful life as set by FTA and is ready for disposal. City of Norman Public Works Fleet Division has inspected the vehicle and believes it to be serviceable while the City works to replace vehicles over the coming years. A description of the vehicle is below:

Accepting the transfer of this vehicle from EMBARK will aid the City in meeting its complementary ADA paratransit obligations as part of operating a federally funded transit system.  If approved, the City will own 14 paratransit vehicles and operate 10-12 paratransit vehicles on a daily basis to meet demand.

 

Chapter IV, § 3(l)(7)(b) of FTA Circular FTA C 5010.1D, entitled, “Grant Management Requirements,” allows an FTA grantee to transfer rolling stock to another FTA grantee with prior FTA approval and requires the receiving grantee’s board to adopt a resolution as part of the approval seeking process.  Such resolution “should identify the transferring grantee, a statement that the vehicles are needed for revenue service, a list of the vehicles to be acquired including VINs, the remaining Federal interest for each vehicle, agreement that the vehicles will be maintained in accordance and in compliance with FTA requirements, and that the transferred vehicles will be included in its equipment inventory records.”  Resolution R-1920-118 satisfies these federal regulation requirements, approves the transfer of the paratransit vehicle, and authorizes the City Manager or his designee to execute the necessary and appropriate contracts and instruments to carry out the transfer of the vehicle and to request approval of the transfer from the FTA.  

 

RECOMMENDATION:  Staff recommends approval of Resolution R-1920-118, accepting the transfer of the aforementioned vehicle from EMBARK, agreeing to maintain the vehicle in accordance and in compliance with FTA requirements, and authorizing the City Manager or his designee to execute the necessary appropriate contracts and instruments to carry out the transfer and to request approval of the transfer from the FTA.
