FINAL ACCEPTANCE AND FINAL PAYMENT OF CONTRACT K-1617-97 BY AND BETWEEN THE CITY OF NORMAN, OKLAHOMA, AND MGA SCULPTURE STUDIO, L.L.C., FOR THE WESTWOOD COMPLEX SCULPTURE PROJECT.

BACKGROUND: The City of Norman, the Norman Arts Council (NAC) and the Public Arts Board (PAB) have partnered in projects to install art in public places within the City of Norman.  Through this partnership, the NAC has purchased art pieces, and the City provides a location for the piece(s) within public spaces owned by the City of Norman.

 

Under the terms of the Services Agreement with the NAC, the City of Norman will fund public art installed at or as a part of NORMAN FORWARD sales tax funded projects up to 1% of construction costs for: Central Library, East Library, Indoor Sports Complex Facility, Indoor Aquatic Center, Westwood Recreational Complex, Ruby Grant Park, Andrews Park, Saxon Park, Reaves Park, and Griffin Park.

 

NORMAN FORWARD art projects for the Westwood Family Aquatic Facility and Westwood Tennis Center were combined to create one large art piece. The artist, Mark Aeling, with MGA Sculpture Studio, was to create a piece of sculpture, entitled “Splash,” to be installed at the Westwood Complex.

 

DISCUSSION: On January 24, 2017 the Westwood Complex Sculpture Project was awarded to MGA Sculpture Studio, LLC in the amount of $100,000. Partial payments were made on February 8, 2017, February 17, 2017, and August 7, 2017 in the amount of $25,000 each, as per the contract.

 

On December 7, 2017 City of Norman Parks and Recreation staff inspected the sculpture and found it to be complete as per specifications.

 

This final payment reflects a deduction of $ $2,300 by the artist as a result of not having to rent equipment needed to unload and place the sculpture at the site. This equipment was provided by the City of Norman.

 

RECOMMENDATION: It is recommended that City Council accept the Westwood Complex Sculpture Project as complete and authorize final payment in the amount of $22,700 to MGA Sculpture Studio, LLC. Funding is available in the NORMAN FORWARD Public Arts Projects, Construction (account number 051-9500-452.61-01; project NFP100).
