CONTRACT NO. K-1213-188: A CONTRACT BY AND BETWEEN THE CITY OF NORMAN, OKLAHOMA, AND PLAINS PIPELINE, L.P. IN AN AMOUNT NOT TO EXCEED $131,543.07 TO RELOCATE A PIPELINE FOR THE CEDAR LANE WIDENING PROJECT AND BUDGET APPROPRIATION.

BACKGROUND: The Cedar Lane Road Widening Project involves the construction of a new four-lane roadway between 12th Avenue SE and ½ mile east of 24th Avenue SE, including five-foot wide bike lanes on each side of the road. The project will also include improvements to 12th Avenue SE and 24th Avenue SE as they approach Cedar Lane Road, improve the BNSF railroad crossing and resurface US-77 on the north and south sides of Cedar Lane Road. Signalization of the 12th Avenue SE and Cedar Lane Road intersection will also help relieve traffic congestion at peak travel times during the day.
On November 22, 2011 City Council approved programming Resolution R-1112-60 requesting federal funds to widen Cedar Lane Road to four lanes between 12th Avenue SE and ½ mile east of 24th Avenue SE. This resolution states the City’s commitment to adhere to the terms and conditions of a federally funded project. Through the Association of Central Oklahoma Governments (ACOG), the Oklahoma Department of Transportation (ODOT) agrees to pay 80% of the construction cost with a 20% matching share from the City of Norman.
On August 28, 2012, the citizens of Norman voted in favor of a Bond Issue to finance the local share of eight transportation/storm water improvement projects. One of the eight 2012 bond projects is the Cedar Lane Road Widening Project.
Acquiring rights-of-way and relocating utilities is essential to receive ACOG funding. Staff is currently in the process of acquiring the necessary rights-of-way with a third of the parcels secured. Similarly, staff has received plans from all utility companies and has assigned each utility a corridor. In order to complete the relocations ahead of schedule, staff is acquiring a right of entry agreement from each parcel. The right of entry agreement will allow each utility company to relocate before staff procures the required rights-of-way.
DISCUSSION: Utilities are being relocated as required by the above-mentioned contract for the Cedar Lane Road Widening Project. Plains Pipeline, L.P. is requesting the City sign the relocation agreement to relocate their facility within their private right-of-way. Plains Pipeline, L.P. operates a twelve inch oil pipeline in their private right-of-way, which crosses the City’s 66 foot statutory right-of-way. The relocation will require Plains Pipeline, L.P. to install 300 feet of steel pipeline. The City will be responsible for the cost of relocating 234 feet, or 66.7% of the total relocation.
The cost for relocating Plains’ pipeline is estimated at $197,216, of which the City will be responsible for 66.7% or $131,543.07. Plains Pipeline, L.P. is performing maintenance on this pipeline and is planning on completing the necessary relocation for the Cedar Lane Road Widening Project at the same time.
RECOMMENDATION: City Council recently authorized the first sale of General Obligation Bonds for the 2012 Bond Program. Funds are available for this project from the proceeds of the bond sale. Staff recommends appropriating $131,543.07 from the Capital Fund Balance, (account 050-0000-253.20-00) to the Capital Fund, Cedar Lane Road Widening Project (account 050-9079-431.67-01; project BP0196).
