BACKGROUND: On August 28, 2012, the citizens of Norman voted in favor of a Bond Issue to finance the local share of eight transportation/storm water improvement projects One of the eight 2012 bond projects is the Cedar Lane Road Widening Project.  The Cedar Lane Road Widening Project involves the construction of a new four-lane roadway between 12th Avenue SE and ½ mile east of 24th Avenue SE, including five-foot bike lines on each side of the road.  The project will also include improvements to 12th Avenue SE and 24th Avenue SE as they approach Cedar Lane Road, improvements to the BNSF railroad crossing and resurfacing of US-77 (Classen Boulevard) on the north and south sides of Cedar Lane Road.  Signalization of the 12th Avenue SE and Cedar Lane Road intersections will also help relieve traffic congestion at peak travel times during the day.

 

On November 22, 2011 City Council approved programming Resolution No. R-1112-60 requesting federal funds to widen Cedar Lane Road to four lanes between 12th Avenue SE and ½ mile east of 24th Avenue SE.  This Resolution states the City’s commitment to adhere to the terms and conditions of a federally funded project.  Through the Association of Central Oklahoma Governments (ACOG), the Oklahoma Department of Transportation (ODOT) agrees to pay 80% of the construction cost with a 20% matching share from the City of Norman. 

 

On April 23, 2013, City Council approved Contract No. K-1213-183, a Right-of-Way and Utility Agreement with the Oklahoma Department of Transportation, for the construction of the Cedar Lane Road Widening Project.  This agreement requires the City to acquire right-of-way and relocate utilities for this project.  Staff has received plans from all twelve (12) utility companies and has assigned each utility a corridor within the City’s right-of-way.  With the exception of OG&E, which is waiting for the last 8 parcels to be acquired, all utility companies have been provided a notice to proceed.  This notice will allow each company to begin bidding the work to contractors, expediting the relocation process.

 

DISCUSSION:  The City of Norman must have all utility relocations in place by December 31, 2013.  Cimmarron Gathering, L.P. owns a 4-inch oil pipeline in their private right-of-way which crosses the City’s 66-foot statutory right-of-way on Cedar Lane Road.  Whenever the City’s right-of-way only encompasses the 66 foot statutory right-of-way, any work outside of the statutory 66 feet and within the private easement is to be funded completely by the City.  The proposed contract with Cimarron Gathering LP represents part of the utility relocation process.  Since the pipeline is inactive, the pipeline can be cut and capped along the north and south right-of-way limits of Cedar Lane Road.  Capping the pipeline at the right-of-way limits will prevent possible delays during construction.   

 

The cost to cut and cap the Cimmarron Gathering pipeline is $11,569.  The cutting and capping of Cimarron Gathering’s pipeline was accounted for when budgeting for the Cedar Lane Road Widening Project.  Staff budgeted $475,000 for utility relocations.   

 

RECOMMENDATION: Staff recommends that Council approve Contract No. K-1314-45 with Cimmarron Gathering L.P.
