AMENDMENT NO. ONE TO CONTRACT K-1516-78: BY AND BETWEEN THE NORMAN TAX INCREMENT FINANCE AUTHORITY AND SMC CONSULTING ENGINEERS, P.C., INCREASING THE CONTRACT AMOUNT BY $4,500 FOR A REVISED CONTRACT AMOUNT OF $45,500 FOR ADDITIONAL ENGINEERING DESIGN SERVICES FOR 24TH AVENUE N.W. AND RADIUS WAY INTERSECTION PROJECT.

BACKGROUND: On August 22, 2006, City Council approved Development Agreement No. One (Contract K-0607-45) by and between the Norman Tax Increment Finance Authority and the University Town Center L.L.C., for the initial project activities associated with the traffic improvements needed to mitigate the additional traffic generated by the University North Park (UNP) development. Development Agreement No. 1 includes the list of required traffic/transportation improvements for the UNP Development. Among the projects listed are five intersections on 24th Avenue NW. Development Agreement No. 1 addresses the funding of these projects through the University North Park Tax Increment Finance Authority. Approval of the costs associated with this intersection will still be within the maximum $11.55 million authorized for UNP TIF funded traffic and roadway improvements.
The City has constructed four of the five intersections along 24th Avenue NW as listed below:
Mount Williams Drive
Conference Center Drive
Legacy Park Drive
Corporate Center Drive
The fifth and final intersection is Radius Way Drive, which is located half way between Rock Creek Road and Corporate Center Drive. (See the project location map). This intersection will provide access to a multi-family residential development on the east side of 24th Avenue NW and future development on the west side. The intersection will include left turn bays for northbound and southbound traffic, decorative pavement and decorative traffic signal equipment. On November 24, 2015, Council approved Contract K-1516-78 with SMC Consulting Engineers for the design of the intersection.
DISCUSSION: During the design of the intersection, the design team concluded the existing median opening just south of the intersection needed to be closed. To update the plans to include the closure of the median opening, the fee for the additional design services is $4,500.
The additional design services include:
• Demolition plan for the closing of the median
• Prepare the design for the median closing
• Revise and update the cover sheet, erosion control sheet & roadway quantity sheets
The current design fee is $41,000. With the additional $4,500 design fee the total cost for the intersection design is $45,500, or 5.7% of the estimated construction cost of $790,000. Industry standards call for engineering design services to typically be between 7% and 12% of the project construction cost, depending on the complexity of the project. This is not a complex project and the design fees are reasonable. Funds are available to cover the design cost of Amendment No. 1 in the design account (Account No. 057-9403-431.62-01, Project No. UT0012) for the 24th Avenue NW and Radius Way Intersection Project. The source of funding is the University North Park Tax Increment Finance Authority.
If approved, SMC will complete the design of the project by September 2016. A bid opening will be held in October 2017. Construction of the intersection is anticipated to begin in January 2017. Completion of these improvements is expected by April 2017 in time for the opening of the new apartment complex being built as a part of University North Park Section XIV.
RECOMMENDATION: Staff recommends approval of Amendment No. 1 to Contract K-1516-78 between the City of Norman and SMC Consulting Engineers, P.C. for the design of the 24th Avenue NW and Radius Way Intersection Project.
