CONTRACT K-1718-95:  A CONTRACT BY AND BETWEEN THE NORMAN MUNICIPAL AUTHORITY AND MARC CLAUDE` FOR THE WESTWOOD TENNIS PROFESSIONAL EMPLOYMENT AGREEMENT FOR THE PARKS AND RECREATION DEPARTMENT FOR A PERIOD OF FIVE YEARS.

BACKGROUND: The City has employed a tennis professional to help program and organize operations at the Westwood Tennis Complex.  Mr. David Minihan, the  Westwood Park Tennis professional, accepted another job opportunity with the City of Edmond and his contract was terminated December 31, 2017 as per his request in his letter of resignation. The Assistant Director of Tennis, Marc Claude’, has been a part of the Westwood Tennis Center for the past 21 years and has been instrumental in organizing and implementing all aspects of junior and adult tennis development. 

 

DISCUSSION: Due to the collaboration of efforts between David Minihan and Marc Claude’, Westwood Tennis Center has received national recognition for the Outstanding Junior Tournament for 15 consecutive years as the host of the United States Tennis Association (USTA) Boys and Girls 16’s National Open. Westwood Tennis Center and hosted the Missouri Valley sectional tournaments for the past five years.

 

Westwood Tennis Center had been one of three sites in Oklahoma to host the USTA Missouri Valley Adult League Championship. In 2011, Westwood Tennis Center won the USTA Missouri Valley and USTA Oklahoma Tournament of the Year for the Missouri Valley Summer Sectional Tournament.

 

The Westwood Tennis Center also provides adult classes and league play. They provide a college program “Tennis on Campus” for which they have won district and sectional awards for their volunteer efforts.

 

The proposed contract extended to Marc Claude’ for his services as the Tennis Professional includes compensation of $1,250 monthly ($15,000 annually), the same compensation contract previously enjoyed by Mr. Minihan.  Mr. Claude’ will also receive revenue from tennis lessons and from the sale of pro shop merchandise, which he provides.

 

Contract K-1718-95 with the City agrees to employ Mr. Claude’ for a five year term. The terms and conditions of the proposed contract are the same as those in the previous contract with the exception of two additional terms that have been added at the recommendation of the City’s Bond Counsel. Those terms state that the Professional and his staff shall not have exclusive rights to providing lessons at the tennis facility, and that the City shall have the right to adjust rates for special events and tournaments if deemed appropriate.  These terms are added to make the contract compliant with current Internal Revenue Service requirements relative to capital improvements provided by tax exempt bond funding.  

 

Adequate funds are available in expenditure Other Professional Services (account 010-7021-451.40-99).

 

RECOMMENDATION: It is recommended that City Council approve Contract K-1718-95 to employ Marc Claude’, for the Westwood Tennis Professional position for the Parks and Recreation Department.
