BACKGROUND:  The 2005 - Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) allocates approximately $15 Million in Federal funds per year for the implementation of eligible transportation improvements in the Oklahoma City metropolitan area.  Pavement overlay projects along functionally classified roadways are eligible for 80% federal funding.
 
On June 14, 2011, City Council approved Resolution R-1011-131 which was forwarded to both the Association of Central Oklahoma Governments (ACOG) and the Oklahoma Department of Transportation (ODOT) requesting federal funds to pay for 80% of the construction cost of pavement overlays along the following roadway segments:
 
      Tecumseh Road, between 60th Avenue NW and Healthplex Parkway
      24th Avenue NW, between Boardwalk and Tee Drive
      Lindsey Street, between 36th Avenue SW and Ed Noble Parkway
 
On September 25, 2012, City Council approved Contract No. K-1213-81 and Resolution No. 1213-55 in which the City agreed to the terms and conditions of a federally funded project by stating its willingness to assume the responsibility for the preparation of engineering plans, the purchase of any additional right-of-way, the relocation of public utilities and funding of the local share of the construction cost, which for this project is 20% of the construction. The project was submitted to the Association of Central Oklahoma Governments (ACOG) and is included in the 2013 Element of the Regional Transportation Improvement Plan (TIP).
 
Construction plans were developed in-house by the Traffic Control Division and submitted to ODOT with a request to include the project in their January 2013 bid opening. In addition to the pavement overlays, the project includes new striping and some sidewalk and sidewalk ramp upgrades. The construction is anticipated to begin in the Spring of 2013 with completion of the work in early summer of the same year.
 
DESCRIPTION:  The Oklahoma Department of Transportation requires the City to execute a project agreement and to adopt it by resolution before letting the project to contract. The agreement addresses the responsibilities of the City and ODOT during and after the construction of the project. The execution of three original documents is required. Both the resolution and agreement have been reviewed by staff and approved by the City Attorney.
 
The project was originally intended to be funded locally in its entirety. The availability of federal funds afforded staff the opportunity to increase the project scope and to pursue federal funding  for the estimated $1.22 million dollar project.  An estimated $976,000 (80%) in federal funds was secured, with $244,000 (20%) to be provided by local funds.
 
The Street Division has funds in three project numbers, set up for these particular streets under the Account No. 050-9511-431.61-01, totaling $153,785 that  will be used to partially fund the City's $244,000 local share of the project. A supplemental appropriation of $90,215 from Capital Funds Balance Account No. 050-0000-253.20-00 is needed to fully fund the City's portion which has to be sent to ODOT before the project letting can occur.
 
RECOMMENDATION NO. 1:  Staff recommends approval of Contract No. K-1213-127 and Resolution No. R-1213-80 with ODOT for the pavement overlays project on segments of Tecumseh Road, 24th Avenue NW, and West Lindsey Street.
 
RECOMMENDATION NO. 2:  Staff also recommends authorization to issue payment to the Oklahoma Department of Transportation in the amount of $244,000 for the City's 20% local funding share of this project.  To do this, staff recommends an appropriation of $90,215 from the Capital fund balance to supplement existing funds for this local share.  If approved, the following adjustments to the construction accounts (050-9511-431.61-01) will be made as follows:
 
$45,108 to be appropriated to Project No. SC0521, Tecumseh: 48th NW - N. Interstate, Construction
$21,200 to be appropriated to Project No. SC0522, Lindsey: Shadowridge -Ed Noble, Construction
$23,907 to be appropriated to Project No. SC0523, 24th NW: Boardwalk - Tee Drive, Construction
