CONSIDERATION OF AWARDING BID-2021-14, APPROVAL OF CONTRACT K-2021-30 BY AND BETWEEN THE CITY OF NORMAN, OKLAHOMA, AND NASH CONSTRUCTION COMPANY IN THE AMOUNT OF $258,122.50 FOR THE FYE 2021 CONCRETE SIDEWALK PROJECT, PERFORMANCE BOND B-2021-29, STATUTORY BOND B-2021-30, AND MAINTENANCE BOND MB-2021-16, RESOLUTION R-2021-21 GRANTING TAX EXEMPT STATUS; AND BUDGET TRANSFER.

BACKGROUND: There are several sidewalk projects that have been requested and are currently funded.  The Fiscal Year Ending June 30th, 2021 (FYE 2021) Sidewalk Program for Schools and Arterials included two (2) concrete sidewalk projects in existing neighborhoods: on Cruce Street from Pickard Avenue to Flood Avenue; and Berry Road from Boyd Street to Brooks Street.  These locations have been requested by citizens and Councilmembers to improve access to pedestrians and persons with disabilities.  The sidewalks on the north side of Main Street from Berry Road to Park Avenue were also identified in the Americans with Disabilities (ADA) Transition Plan Update as a high priority.  Finally, there has been funding budgeted in previous years to complete the sidewalk gaps on Brooks Street between Jenkins Avenue and Classen Avenue.  All of the projects are similar in nature and more competitive bids have historically been obtained by bidding them together.  Therefore, staff has combined these sidewalks projects into one bid entitled the FYE 2021 Capital Improvement Project Sidewalks. These four (4) projects and one (1) add-alternate bid on Brooks Street are described in detail below. Maps of each project are attached.

 

Project # 1.  Cruce Street from Pickard Avenue to Flood Avenue.  This project will construct approximately 380 feet of new sidewalk on the north side of the Cruce Street along the block from Pickard Avenue to Flood Avenue across Cruce Street from McKinley Elementary School.  It will be a 4 foot wide sidewalk and include reconstruction of driveway crossings as necessary.  This project is supported by the school and will benefit the students and parents.  All efforts will be taken to avoid tree removal on the east end of the project.

 

Project # 2.  Berry Road from Boyd Street to Brooks Street.  This project will construct approximately 1,200 feet of new sidewalk on the east side of Berry Road from Boyd Street to Brooks Street. It will be a 4 foot wide sidewalk and include reconstruction of driveway crossings as necessary and accessible ramps at intersections.  All efforts will be taken to avoid tree removal throughout the corridor.

 

Project # 3.  Main Street from Berry Road to Park Drive.    This project is a continuation of the sidewalk work identified in the ADA Transition Plan Update.  Two previous projects have been awarded.  The first was in FYE 2019 to repair or replace ADA sidewalk deficiencies on the north side of Main Street from 24th Avenue NW to Berry Road.  This project was funded from the FYE 2019 Concrete Sidewalk Program Sidewalks and Trails Project for $150,000.  The second project was in FYE 2020 on the south side of Main Street from 24th Avenue NW to Park Avenue.  This work is ongoing and was funded from in FYE 2020 Concrete Sidewalk Program Sidewalks and Trails Project in the amount of $131,030.  This final project will replace 2,800 feet of damaged or non-ADA compliant sidewalks along the north side of Main Street from Berry Road to Park Drive. It will be a 5 foot wide sidewalk and include reconstruction of driveway crossings and curb ramps as necessary.

  

Projects # 4.  Brooks Street from Monnett Avenue to Classen Avenue.  This project will consist of a base bid to construct approximately 180 feet of new sidewalk on the north side of Brooks Street from the east right of way of the railroad to Classen Avenue including curb ramps at the northwest corner of the intersection at Classen Avenue.   All efforts will be taken to avoid tree removal throughout the corridor.  An add alternate bid was also included to construct approximately 315 feet of new sidewalk on the north side of Brooks Street from Monnett Avenue to Trout Avenue including driveway crossings as necessary and curb ramps at intersections.   The “add alternate” was used for the second Brooks Street Project due to concerns over the project budget.  Staff is still negotiating the crossing of the BNSF Railroad right of way.  These projects will not complete this section of sidewalk.  Staff will complete the negotiations and have all the sidewalk construction complete within the timeline of this contract.

   

DISCUSSIONBid documents and specifications were advertised according to State Law. Twelve (12) contractors received the bid documents and four (4) bids were received on September 17, 2020. The low bid, in the amount of $258,122.50, was received from Nash Construction Company of Oklahoma City, OK. Nash Construction Company has successfully performed work for the City of Norman on the FYE 2020 Street Maintenance Bond Program. Engineer’s estimate for this work is $260,000, and the total available budget in the FYE 2021 Capital Improvement Program is $254,469.  Table 1 (see attached) shows the bid and funding for each project.  Projects 1 and 2 are underfunded because some of the funds budgeted to this account were used for the funding of the FYE 2021 Concrete Projects.  Staff is requesting the remaining funding in the Brooks Street Sidewalk remain in that account until we have completed negotiations with the BNSF Railroad for the crossing of the tracks.  Staff is requesting that $25,034 be re-allocated to Projects 1 and 2 from the ADA Compliance Audit and Repair Account to compensate for FYE 2019 and 2021 sidewalk work completed on Main Street that was eligible for funding from the ADA Compliance Audit and Repair project.   

 

If approved, construction is scheduled to begin in November 2020. The contractor will stage the five (5) projects to complete sidewalk requests throughout the year and to construct school sidewalk during school winter and summer breaks. The project plan will follow the schedule below:

                     Berry Road -Nov. 2020

                     Cruce Street - December 2020

                     Brooks Street - January & February, 2021 (weather permitting)

                     West Main Street project - March-April, 2021 (weather permitting)

 

Resolution R-2021-21 confers upon Nash Construction Company the limited agent status for the purchase of materials to be incorporated in the project on a sales tax-exempt basis.  The bid documents offered tax-exempt status to all bidders.

 

RECOMMENDATION NO. 1:  Staff has reviewed the bids and recommends that Bid-2021-14 for the FYE 2021 Concrete Sidewalk Program be awarded to Nash Construction Company in the amount of $258,122.50.

 

RECOMMENDATION NO. 2Staff further recommends that the following contract and bonds be approved:

RECOMMENDATION NO. 3Staff further recommends that Nash Construction Company be authorized and appointed as project agent via Resolution R-2021-21.

 

RECOMMENDATION NO. 4Staff further recommends that the FYE 2021 Capital Improvement Project Sidewalks be funded from the FYE 2021 ADA Compliance Audit and Repair account to meet the total contract funding of $258,122.50 and $25,034 be transferred from Project TC0038, ADA Compliance Audit & Repair, Construction (50590026-46101) to Project TC0249, Sidewalk Program for Schools and Arterials, Construction (50593317-46101).
