CONSIDERATION OF AWARDING OF BID 1920-3, APPROVAL OF CONTRACT K-1920-5 BY AND BETWEEN THE CITY OF NORMAN, OKLAHOMA, AND RDNJ, L.L.C., D/B/A A-TECH PAVING, IN THE AMOUNT OF $69,360; PERFORMANCE BOND B--1920-7; STATUTORY BOND B-1920-8; AND MAINTENANCE BOND MB-1920-4 FOR THE DAWS-TONHAWA ALLEY DRAINAGE IMPROVEMENT PROJECT; AND RESOLUTION R-1920-1 GRANTING TAX EXEMPT STATUS.

 

Body

BACKGROUND:  Over the past several years, residents along the alley between Daws Street and Tonhawa Street in the Norman Old Town Addition have experienced flooding and property damage due to stormwater runoff flowing north out of the alley instead of west through the alley.  This portion of the Norman Old Town Addition was part of the Original Townsite.  In 2018, Public Works Stormwater Division began working with Cardinal Engineering to design improvements to the alley to prevent stormwater from leaving the alley and flooding nearby properties. Based on Cardinal’s analysis, in order to adequately address the flooding in this area, it is necessary to regrade and install an inverted crown in this alleyway (see attached drawing). 

 

DISCUSSION:  In order to complete this project in a timely manner, it is necessary to use private contracting services. On July 3, 2018, using the Agreement for On-Call Engineering Services between City of Norman/Norman Utilities Authority and Cardinal Engineering, Contract K-0910-62, Cardinal Engineering was authorized in the amount of $13,500 to prepare a final design and bid documents for this project.   

 

The bid opening was conducted on September 19, 2019, and two (2) contractors submitted bids.  The Engineer’s Estimate is $104,248.81.  The lowest bid in the amount of $69,360, submitted by RDNJ, LLC “dba” A-Tech Paving, is $34,888.81 (33.5%) below the estimate.  The average of the two (2) bids is $70,030.25.  If approved, construction will begin on this project in November 2019 and will be completed by February 2019.

 

If approved, funding for Contract K-1920-3 in the amount of $69,360 is available in the FYE 2020 Capital Fund, Stormwater Drainage Projects, Construction (account 050-9968-431.61-01; project DR0057).  This project is an ongoing annual Capital Budget Stormwater program to address smaller stormwater drainage problems in neighborhoods, which includes projects such as this.

 

RECOMMENDATION NO. 1: Staff has reviewed the bids and recommends that Bid-1920-3 for the Daws-Tonhawa Alley Drainage Improvements project, be awarded to the low bidder, RDNJ, LLC “dba” A-Tech Paving, in the amount of $69,360. 

 

RECOMMENDATION NO. 2:  Staff further recommends that, upon approval of Bid-1920-3, the following contract and bonds be approved:

 

Contract K-1920-5

Performance Bond B-1920-7

Statutory Bond B-1920-8

Maintenance Bond MB-1920-4

 

RECOMMENDATION NO. 3:  Staff further recommends that, upon approval of Contract K-1920-5, Resolution R-1920-1 be adopted authorizing RDNJ, LLC “dba” A-Tech Paving as project agent to avoid the payment of sales tax on materials purchases for the project.
