CONSIDERATION OF AWARDING OF BID 1718-39; CONTRACT K-1718-91 BY AND BETWEEN THE CITY OF NORMAN, OKLAHOMA, AND GARDEN DEPOT, INC., D/B/A 4-D LAWN AND LANDSCAPE COMPANY IN THE AMOUNT OF $245,490.17; PERFORMANCE BOND B-1718-55, STATUTORY BOND B-1718-56, AND MAINTENANCE BOND MB-1718-39 FOR THE LINDSEY STREET LANDSCAPING PROJECT; AND ADOPTION OF RESOLUTION R-1718-75 GRANTING TAX EXEMPT STATUS.

 

Body

BACKGROUNDOn August 28, 2012, the citizens of Norman voted in favor of a Bond Election to finance the local share of eight transportation/stormwater improvement projects. One of the eight 2012 bond projects is West Lindsey Street from 24th Avenue S.W. to Berry Road.

 

The project included transportation and aesthetic improvements to Lindsey Street.  The West Lindsey Street corridor between Interstate 35 and Berry Road is the most congested corridor in the Oklahoma City metropolitan area. This section of West Lindsey Street has a traffic accident rate three (3) times the national average. 

 

Improvements for the roadway project included:

 

1.                     Widening West Lindsey Street from 3 lanes to 4 lanes with additional lanes at intersections

2.                     New bridge over Imhoff Creek

3.                     Continuous sidewalks on both sides of the street

4.                     Access management to adjacent properties

5.                     Multi-modal improvements including bicycle lanes

6.                     Aesthetic enhancements including decorative pavement and roadway lighting

7.                     Underground utilities

8.                     Accessibility to disabled individuals

 

The Lindsey Street 2012 Bond Project construction bid amount was $26,934,865.43.  Construction of the roadway project began July 5th, 2016, with an estimated construction time of 540 days. The project was considered substantially complete and open to traffic on December 15th, 2017. With construction nearing completion, the landscaping of the Lindsey Street Bond Project can begin.

 

On August 22, 2017, City Council approved Amendment No. 4 to Contract K-1213-126 providing for the preparation of final plans and specifications for landscaping improvements.  The landscaping improvements are located in the center median and along both sides of Lindsey Street.  The City chose to bid and contract the landscaping improvements separate from the ODOT administered Street and Stormwater project for the following reasons:

 

                     Cost savings

                     Quality of work and materials

                     Landscaping not eligible for federal funding

                     Scheduling control

 

This approach to landscaping on major road projects has been successfully utilized on previous projects in Norman including Robinson Street Underpass, the I-35 and Main Street Interchange and the I-35 and Lindsey Street Interchange.

 

DISCUSSION:  Bid documents and specifications for the Lindsey Street Landscaping Project were advertised on January 4th, 2018 and January 11th, 2018 in accordance with State Law.  Eleven (11) potential bidders acquired plans and specifications.  Nine (9) bids were received on January 18, 2018.

 

The low bidder is Garden Depot, Inc. d/b/a 4-D Lawn and Landscape Company of Lawton, Oklahoma, in the amount of $245,490.17.  This is $6,179.83 less than the next lowest bidder.  The Engineer’s Estimate for this project is $380,291.  The low bid was 64.6% of the Engineer’s Estimate.  Staff, as well as the consultant for this project, have done a comparative analysis of these quotes and believe this quote is competitive and represents a fair price.

 

The funding of this project will be from Lindsey Street - 24th Avenue SW to Berry Road Widening Construction (account 050-9552-431.61-01; project BP0189).  The current balance in this account is $769,888.  This action will leave a balance of $524,397.83.

 

If approved, construction of landscaping items will begin on February 15th, 2018, and plantings should be completed by April 15, 2018. 

 

RECOMMENDATION No. 1:  Staff and our consultant have reviewed the bids and recommend the Bid 1718-39 for the Lindsey Street Landscaping be awarded to the low bidder, Garden Depot, Inc. d/b/a 4-D Lawn and Landscape Company for $245,490.17.  Grissom’s Nursery submitted an incomplete bid.

 

RECOMMENDATION No. 2:  Staff further recommends that, upon approval of Bid 1718-39, the following contract and bonds be approved:

 

Contract K-1718-91

Performance Bond B-1718-55

Statutory Bond B-1718-56

Maintenance Bond MB-1718-39

 

RECOMMENDATION No. 3:  Staff further recommends that, upon approval of Bid 1718-39, Garden Depot, Inc. d/b/a 4-D Lawn and Landscape Company be authorized and appointed as Project Agent via Resolution R-1718-75.
