CONSIDERATION OF AWARDING OF BID 2021-2; CONTRACT K-2021-2 BY AND BETWEEN THE CITY OF NORMAN, OKLAHOMA, AND FIRST WATER CONTRACTING, L.L.C., IN THE AMOUNT OF $1,258,743; PERFORMANCE BOND B-2021-3; STATUTORY BOND B-2021-4, AND MAINTENANCE BOND MB-2021-2 FOR THE URBAN ASPHALT PAVEMENT PROJECT, FYE 2021 LOCATIONS; AND RESOLUTION R-2021-1 GRANTING TAX EXEMPT STATUS.

BACKGROUND: In the Norman General Obligation Bond Election of 2016, voters approved the Street Maintenance Bond Program, a 5-year, 4-phase program to address maintenance needs on neighborhood streets. The four categories include (1) Urban Asphalt Street Rehabilitation, (2) Urban Concrete Street Rehabilitation, (3) Urban Road Reconstruction and (4) Rural Road Rehabilitation. Prior to the election, the City provided a list of all streets included in the program based upon the pavement condition data from the City’s current Pavement Management System. The following is the list of the FYE 2021 Urban Asphalt Pavement project locations included in this project:
• Parkridge Road (Concord Dr. / S. 1700 Block)
• Willowisp Drive (Willoway Dr. / Willowpoint Dr.)
• Santa Fe Avenue (Main St. / Eufaula St.)
• Comanche Street (Santa Fe Ave. / Lahoma Ave.)
• Elm Ave (Boyd St. / Symmes St.)
• Stubbeman Avenue (North End / Himes St.)
• Crawford Avenue (Haddock St. / Dale St.)
Several Street Maintenance Bond Program Urban Asphalt Street Rehabilitation projects, originally planned for FYE 2021, have previously been completed with other contracts using savings from completed bond projects. Because these projects have already been completed, staff has included additional streets in this contract, based upon the pavement condition data from the City’s current Pavement Management System. The following additional Asphalt Pavement project locations are included in this project:

• Fay Ave. (Robinson St. / Ridge Rd.)
• Johnson St. (Fay Ave. / BNSF Right-of-Way)
• Crystal Bend (Chandelier Dr. / Crystal Cir.)
• Crystal Ct. (Crystal Bend / Cul-de-Sac)
• Skylark Ct. (Crystal Cir. / Cul-de-Sac)
• Falcon Ct. (Crawford Ave. / Cul-de-Sac)
• Chandelier Dr. (Crystal Cir. / Crystal Bend)
The roadways included in this project are located in established residential neighborhoods. The current roadways are constructed of asphalt pavement. The asphalt pavement is in poor condition. This project involves rehabilitation of the existing pavement including milling, deep patching, overlaying with new asphalt, and crack sealing.
DISCUSSION: Bid documents and specifications for the Street Maintenance Bond Program - Urban Asphalt Pavement, FYE 2021 Locations Project were advertised on May 28, 2020 and June 4, 2020 in accordance with State Law. Six (6) asphalt contractors submitted bids for this project on June 18, 2020.
The low bidder is First Water Contracting, LLC, of Oklahoma City in the amount of $1,258,743. This is $145,227 or 10.3% below the Engineer’s Estimate of $1,403,970. Staff has done a comparative analysis of these bids, and believes the bid to be competitive and represents a fair price. The bid tabulation is attached.
First Water Contracting, LLC, is a responsible bidder. They have successfully completed numerous paving projects including a new roadway at Lake Draper for the City of Oklahoma City (WM-0269), which cost $1,434,378.00 and was completed in 2019.
This project will be funded from the following Urban Asphalt Project No’s: BP0458, BP0459, BP0460, BP0461, BP0462, BP0463, BP0464, BP0465, BP0466, and BP0467 (Org 50594401; Object 46101).
If approved, construction of the Street Maintenance Bond Program - Urban Asphalt Pavement, FYE 2021 Locations Project will begin in August 2019. The construction time for this project is 240 days with an estimated completion of April 2021.
RECOMMENDATION NO. 1: Staff has reviewed the bids and recommends Bid 2021-2 for Street Maintenance Bond Program - Urban Asphalt Pavement, FYE 2021 Locations Project be awarded to the low bidder, First Water Contracting, LLC of Oklahoma City, Oklahoma, for $1,258,743.
RECOMMENDATION NO. 2: Staff further recommends that, upon approval of Bid-2021-2, the following contract and bonds be approved:

Performance Bond B-2021-3
Statutory Bond B-2021-4
Maintenance Bond MB-2021-2
RECOMMENDATION NO. 3: Staff further recommends that, upon approval of Bid 2021-25, First Water Contracting, LLC, be authorized and appointed as Project Agent via Resolution R-2021-1 to avoid the payment of sales tax on materials purchases related to the projects.
