CONSIDERATION OF A FINAL SITE DEVELOPMENT PLAN AND A FINAL PLAT FOR PARK 7 GROUP ADDITION, A PLANNED UNIT DEVELOPMENT, DEFERRAL OF PAVING AND SIDEWALK IMPROVEMENTS IN CONNECTION WITH 12TH AVENUE S.E., AND ACCEPTANCE OF PUBLIC DEDICATIONS CONTAINED THEREIN, (GENERALLY LOCATED ONE-QUARTER MILE NORTH OF CEDAR LANE ON THE EAST SIDE OF 12TH AVENUE S.E.)

BACKGROUND: This item is a final plat and final site development plan for Park 7 Group Addition, a Planned Unit Development, and is generally located one-quarter mile north of Cedar Lane Road on the east side of 12th Avenue S.E.
City Council, at its meeting of August 13, 2013, adopted Ordinance No. O-1213-56, placing this property in the Planned Unit Development District and removing it from A-2, Rural Agricultural District. Also, City Council, at its meeting of August 13, 2013 approved the preliminary plat for Park 7 Group Addition, a Planned Unit Development. The City Development Committee, at its meeting of March 25, 2014, reviewed the final plat and program of improvements for Park 7 Group Addition, a Planned Unit Development, and recommended that the final plat be submitted to City Council including deferral of paving and sidewalk improvements in connection with 12th Avenue S.E.
This property consists of 32.97 acres of multi-family development consisting of 304 units.
Privately maintained detention ponds and open space areas will be utilized within the development.
DISCUSSION: Staff has reviewed the required construction plans. Improvements for this property consist of water with fire hydrants, internal sanitary sewer is private, paving, storm drainage and sidewalks. Staff is recommending deferral of paving and sidewalk improvements in connection with 12th Avenue S.E. Approximately 676-feet of 12th Avenue S.E. will be required to be constructed to City standards as a half width 4-lane arterial street. Section 19-602B 1.2 (a) (b) (c) and (d) of the City Code establishes a method of deferring public street improvements under the following situations: (a) where incompatible grades exist; (b) where there are inadequate or a lack of connecting facilities; (c) where construction of the improvements would not immediately function for its intended use; or (d) where such improvements would be replaced by a planned future project. The City’s 2012 Bond Program includes improvements to 12th Avenue S.E., to be constructed in 2017.
The developer is required to post a certificate of deposit with the City in a special account to be used with a future paving project or at such time sufficient development occurs adjacent to the property. Staff has observed over the years that gap paving or “piecemeal” paving has been a detriment to arterial streets. Because of the short length of pavement, staff is recommending deferral until future development occurs.
The City Development Committee, on January 21, 2014, accepted Subdivision Bond No. B-1314-83 securing the public improvements and allowing the approval of a foundation only building permit.
The City Development Committee accepted water improvements for Phase 1. This allowed the developer to go vertical with their construction for 11 buildings.
The developer will fund traffic signalization improvements at State Highway No. 9 and 12th Avenue S.E.
The Norman Board of Parks Commissioners, at its meeting of June 6, 2013, recommended fee in lieu of park land dedication. A fee in the amount of $17,368.75 has been determined by staff.
Also, the property owner and owner of the active oil wells have worked an arrangement on future accessibility, fencing and operation of electrical lines and oil lines and other procedures as the property develops around the existing sites.
STAFF RECOMMENDATION: The final plat and final site development plan are consistent with the preliminary plat. Based upon the above information, staff recommends approval of the final plat and final site development plan, acceptance of the public dedications contained therein and authorize the Mayor sign the final plat and subdivision bond for Park 7 Group Addition, a Planned Unit Development, subject to receipt of $127,636.50 for deferral of paving and sidewalk improvements in connection with 12th Avenue S.E.
