CONSIDERATION OF ORDINANCE O-1617-43 UPON SECOND AND FINAL READING: AN ORDINANCE OF THE COUNCIL OF THE CITY OF NORMAN, OKLAHOMA, AMENDING ARTICLE I, SECTION 4-101 OF CHAPTER 4, ARTICLE V, OF THE CODE OF THE CITY OF NORMAN BY ADDING PROVISIONS TO PROVIDE FOR THE APPOINTMENT OF A CITIZEN MEMBER AND ALTERNATE TO THE CENTER CITY FORM BASED CODE DEVELOPMENT REVIEW TEAM; AND PROVIDING FOR THE SEVERABILITY THEREOF.

BACKGROUND: As part of the proposed Center City Form Based Code, a citizen, and an alternate citizen, are proposed to be appointed to the Development Review Team that will be tasked with reviewing proposed developments under this form based code and issuing Certificates of Compliance for those developments that meet the standards of the form based code.
DISCUSSION: In order to provide for the procedure to appoint and confirm the citizen member to the Center City Form Based Code Development Review Team, Staff has proposed an amendment to Chapter 4 of the Code of Ordinances. Currently, Chapter 4, in Section 4-101, lists fifteen (now proposed to be sixteen) boards or commissions that have members nominated by the Mayor and confirmed by a majority of Council. Section 4-101(b) establishes the number of persons to be appointed to each board or committee and the duration of the terms of appoint. For the Center City Form Based Code Development Review Team, one citizen member and one citizen alternate member are proposed to be appointed for three year terms. The alternate citizen member shall serve in instances when the citizen member is unable to attend, and the citizen member has provided at least forty-eight (48) hours’ notice of his or her unavailability.
RECOMMENDATION: If Council wishes to adopt the Center City Form Based Code as written, with a citizen member and alternate serving on the Center City Form Based Code Development Review Team, Staff recommends adoption of Ordinance O-1617-43 in order to provide for the nomination, confirmation, and term of service of the citizen member and alternate.
