CONTRACT K-1213-169: A CONTRACT BY AND BETWEEN THE CITY OF NORMAN, OKLAHOMA, AND ATKINS NORTH AMERICA, INC., IN AN AMOUNT NOT-TO-EXCEED $875,266.50 TO PROVIDE ENGINEERING DESIGN SERVICES FOR THE EAST 24TH AVENUE IMPROVEMENT PROJECT FROM LINDSEY STREET TO ROBINSON STREET AND BUDGET APPROPRIATION.

BACKGROUND: On August 28, 2012, the citizens of Norman voted in favor of General Obligation Bonds to finance the local share of eight transportation/storm water improvement projects (please see Attachment A, listing the approved bond projects with their estimated cost; and Attachment B, a map of the bond projects). One of the eight 2012 bond projects is the East 24th Avenue Widening Project (Attachment C is a map showing the boundaries of the 24th Avenue Widening Project).
On November 22, 2011, the Norman City Council approved Programming Resolution R-1112-62 requesting federal funds for the East 24th Avenue Widening Project. This Resolution states the City's commitment to adhere to the terms and conditions of a federally-funded project including engineering design, acquisition of all necessary rights-of-way, and relocation of utilities and encroachments at 100% the City's cost. In return, the Association of Central Oklahoma Governments (ACOG) as administrator of U.S. Department of Transportation Surface Transportation Program funding, through the Oklahoma Department of Transportation (ODOT), agrees to provide 80% of the construction cost, estimated at $7,830,400, and administration of the construction with the matching share from the City of Norman.
Proposed improvements for the East 24th Avenue Widening Project include:
- Widen two miles of roadway from two lanes to four lanes
- New traffic signal at East 24th Avenue and Meadowood Boulevard
- Intersection improvements at East 24th Avenue/Meadowood Boulevard and East 24th Avenue/Robinson Street.
- Interconnect signals from Lindsey Street to Robinson Street
- Continuous sidewalks and accessibility
- Storm water improvements
- Possible bike lanes
- Water line relocation.
DISCUSSION: The Public Works Department prepared a request for proposals (RFP) to solicit the engineering services necessary to prepare plans, specifications and bid package, and to provide technical assistance throughout the design and construction of the East 24th Avenue Project. Twelve (12) proposals were received for the project. The Selection Committee included three (3) staff members consisting of Scott Sturtz, City Engineer; Angelo Lombardo, Transportation Engineer; Josh Malwick, Capital Projects Engineer and two (2) private citizens including Tom Knotts, retired, University of Oklahoma Architectural Services; and Mike Fowler, Owner Fowler Holding Company. The Selection Committee members independently scored each proposal on a point scale as defined in the RFP. Upon review of the proposals by the Selection Committee, six (6) firms were selected for interviews. The proposal by Atkins North America, Inc. of Norman was selected for the project.
The attached engineering design services contract is written in a "Cost Not to Exceed" format in the amount of $875,266.50 or 6.7% of the total project cost of $13,007,507. If approved, only the City Council has authority to amend the contract in the future including any changes to the compensation. The contract services include:

Geotechnical Study
Hydraulic Study and Drainage Design
Preliminary Design
Final Design
Public Meetings and Project Team Meetings
As-Built Drawings
If approved, Atkins North America, Inc. will begin work on the project immediately. The project design will be substantially complete by June 2016. Construction of the project is currently anticipated to take place in April 2017.
RECOMMENDATION NO. 1: City Council recently authorized the first sale of General Obligation Bonds for the 2012 Bond Program. Funds are available for this project from the proceeds of this bond sale. Staff recommends appropriating $875,266.50 from the Capital Fund Balance, (Account 050-0000-253.20-00) to the Capital Fund, East 24th Avenue Widening Project (Account 050-9552-431.62-01; Project BP0192).
RECOMMENDATION NO. 2: Staff recommends approval of Contract K-1213-169, between the City of Norman and Atkins North America, Inc. for the design of the East 24th Avenue Widening Project between Lindsey Street and Robinson Street.
