BACKGROUND:  On November 23, 2011, the City received a letter from the Oklahoma Department of Transportation (ODOT) informing the City of plans to perform construction on Highway 9 beginning just west of 24th Avenue SE and extending east along State Highway 9 for approximately 1.5 miles. In the letter, ODOT notified the City of its responsibility to relocate City utilities in advance of construction.
 
On August 25, 2009 the Norman Utilities Authority (NUA) approved Contract K-0910-62 with Cardinal Engineering (Cardinal) for on-call engineering services.  A Request for Proposals process was completed at that time.  The basic design work for the Relocation of Utilities along Highway 9 is the type of project the on-call contract is meant to address. Since the estimate for the design work exceeds $25,000, a new contract with Cardinal was required.
 
On November 13, 2012, the NUA approved Contract K-1213-119 in the amount of $47,000 with Cardinal Engineers for the design of the Highway 9 Waterline Relocation Project. On March 26, 2013 the NUA approved Amendment 1 to Contract K-1213-119 for the design of an additional half mile of 12” waterline to complete a looped system which would also provide an additional water supply for businesses and residents of this area.
 
DISCUSSION:  The construction will require two easements. Easement E-1314-3 is a permanent utility easement crossing the United States Postal Service (USPS) property on the north side of Highway 9. The other easement will be included as a separate item.
 
The USPS has requested $3.50 per square foot of easement area which is equal to the amount paid to USPS by ODOT for their acquisitions for this project. This easement will consist of 9,082 square feet of new easement area. The USPS also requires a $500 review fee. Therefore, the total cost for the easement will be: $3.50 x 9,082 + $500 = $32,287.
 
The Waterline Relocation Project (WA0191) has $49,000 available in Land Acquisition (account 031-9727-462.60-01).
 
RECOMMENDATION:  Staff recommends the NUA authorize payment of $32,287 and accept the Easement E-1314-3 from the USPS.
