CONSIDERATION OF AWARDING BID-2021-39 AND APPROVAL OF CONTRACT K-2021-78 BY AND BETWEEN THE CITY OF NORMAN, OKLAHOMA, AND NASH CONSTRUCTION COMPANY IN THE AMOUNT OF $69,633 FOR THE STREET MAINTENANCE BOND PROGRAM ADA RAMP REPAIR PROJECT, FYE 2021 LOCATIONS, PERFORMANCE BOND B-2021-61, STATUTORY BOND B-2021-62, AND MAINTENANCE BOND MB-2021-46 AND ADOPTION OF RESOLUTION R-2021-72 GRANTING TAX EXEMPT STATUS.

 

Body

BACKGROUND:  In the Norman General Obligation Bond Election of 2016, voters approved the Street Maintenance Bond Program, a 5-year, 4-phase program to address maintenance needs on neighborhood streets. The four categories include (1) Urban Asphalt Street Rehabilitation, (2) Urban Concrete Street Rehabilitation, (3) Urban Road Reconstruction and (4) Rural Road Rehabilitation.  Prior to the election, the City provided a list of all streets included in the program based upon the pavement condition data from the City’s current Pavement Management System. The following is the list of the fiscal year 2020-2021 (FYE 2021) Urban Asphalt Pavement project locations included in this project:

Several Street Maintenance Bond Program Urban Asphalt Street Rehabilitation projects, originally planned for FYE 2021, have previously been completed with other contracts, using savings from completed bond projects.  Because these projects have already been completed, staff has included additional streets in this contract, based upon the pavement condition data from the City’s current Pavement Management System.  The following additional Asphalt Pavement project locations are included in this project:

On July 14, 2020, City Council awarded the FYE 2021 Urban Asphalt Pavement Projects to the low bidder, First Water Contracting, LLC, of Oklahoma City, Oklahoma in the amount of $1,258,743. 

 

On January 5, 2021, First Water’s contract for the above mentioned Urban Asphalt Pavement Projects was considered substantially complete.  Two minor repairs and a small quantity of curb replacement are all that remains on this contract.

 

This proposed agenda item is to address some needed ADA Ramp Repairs within the same limits of the FYE 2021 Urban Asphalt Pavement Projects. 

 

DISCUSSIONDuring the construction of the FYE 2021 Urban Asphalt Pavement Projects, it was discovered that various ADA ramp and sidewalk repairs are needed within the same limits of these projects.  The attached ADA Ramp Repair Table lists the six different additions and multiple streets where these repairs need to be made.

 

Bid documents and specifications for these ADA Ramp projects were advertised beginning on Thursday, December 10, 2020, according to State Law.  Three (3) bids were received by the 2:00 p.m. deadline on Thursday, January 7, 2021. 

 

The low bidder is Nash Construction Company of Oklahoma City, Oklahoma in the amount of $69,633, which is $10,334 lower than the next lowest bid. The Engineer’s estimate was $66,533, which is $3,100 or 4.7% lower than the low bid.  On smaller projects like this, it is difficult to accurately estimate the mobilization and traffic control costs, especially given the multiple locations for these specific repairs.  After reviewing the unit prices and bids of all of the contractors, City staff believes this is a good bid and the mobilization and traffic control costs were underestimated in the Engineer’s Estimate for the proposed scope of the work.

 

This project will be funded from the following Urban Asphalt Project No’s: BP0458, BP0459, BP0462, BP0464, and BP0466 (Org 50594401; Object 46101).

 

If approved, construction of the Street Maintenance Bond Program - ADA Ramp Repair, FYE 2021 Locations Project will begin in about 10 days.  The construction time for this project is 120 days with an estimated completion of June 2021. 

 

RECOMMENDATION NO. 1:  Staff has reviewed the bids and recommends Bid 2021-39 for Street Maintenance Bond Program - ADA Ramp Repair, FYE 2021 Locations Project be awarded to the low bidder, Nash Construction Company of Oklahoma City, Oklahoma, in the amount of $69,633.

 

RECOMMENDATION NO. 2:  Staff further recommends that, upon approval of Bid 2021-39, the following contract and bonds be approved:

 

Contract K-2021-78

Performance Bond B-2021-61

Statutory Bond B-2021-62

Maintenance Bond MB-2021-46

 

RECOMMENDATION NO. 3:  Staff further recommends that, upon approval of Bid 2021-39, Nash Construction Company, be authorized and appointed as Project Agent via Resolution R-2021-72 to avoid the payment of sales taxes on materials purchases related to the project.
