CONSIDERATION OF CONTRACT NO. K-1314-101 WITH SILVER STAR CONSTRUCTION COMPANY, INC., IN THE AMOUNT OF $49,944.54 FOR THE MIKE DESKIN TRUST DRAINAGE CHANNEL IMPROVEMENT PROJECT IN CONNECTION WITH THE CEDAR LANE WIDENING PROJECT AND ADOPTION OF PROJECT AGENT RESOLUTION NO. R-1314-81.

BACKGROUND: On February 8, 2011, City Council approved engineering services Contract No. K-1011-135 with Cardinal Engineering Inc. for the design of the Cedar Lane Road Widening Project for $350,630 or 3.5% of the total estimated project cost. The Cedar Lane Road Widening Project involves the construction of a new four-lane roadway that will include five foot bike lines on each side of the road. The project will also include improvements to 12th Avenue SE and 24th Avenue SE as they approach Cedar Lane Road, improve the BNSF railroad crossing and resurface U.S. Highway 77 on the north and south sides of Cedar Lane Road. Signalization of the 12th Avenue SE and Cedar Lane Road intersection will also help relieve traffic congestion at peak travel times during the day.
On November 22, 2011, the Norman City Council approved programming Resolution R-1112-60 requesting federal funds to widen Cedar Lane Road. This resolution states the City’s commitment to adhere to the terms and conditions of a federally funded project including engineering design, acquisition of all necessary rights-of-way and relocation of utilities and encroachments at 100% the City’s cost. In return, the Association of Central Oklahoma Governments (ACOG), through the Oklahoma Department of Transportation (ODOT), agrees to provide 80% of the construction cost estimated at $6,231,280, and administration of the construction with the matching share (20%) from the City of Norman.
On August 28, 2012, the citizens of Norman voted in favor of a Bond Issue to finance the local share of eight transportation/storm water improvement projects. One of the eight 2012 bond projects is the Cedar Lane Road Widening Project. See the attached location map showing the project boundaries.
On April 23, 2013, City Council approved Contract No. K-1213-183, a Right-of-Way and Utility Agreement with the Oklahoma Department of Transportation, for the construction of the Cedar Lane Road Widening Project. This agreement requires the City to acquire right-of-way and relocate utilities for this project. Currently, all right-of-way has been acquired and all utility companies have been given a notice to proceed.
DISCUSSION: Council approved a Right-of-Way Agreement for the Cedar Lane Widening Project on May 14, 2013 with a property owner in the Cedar Lake Estates residential area north of Cedar Lane Road and east of 24th Avenue SE. The property owner is the Mike Deskin Trust. Mr. Deskin and his spouse reside on the property. As a part of the agreement, the City agreed to improve the drainage channel passing through their front yard and upgrade the culvert under their driveway. In exchange for these channel improvements, the property owner dedicated a permanent public drainage easement. The property owner requested that the channel improvements be made prior to the roadway improvements. The improvements will decrease flooding and allow the new storm water system for Cedar Lane Road to function better in the future. The design consultant completed plans, specifications, and an Engineer’s estimate for the channel improvements. The Engineer’s estimate is $44,985. City Ordinance Section 8-204 allows for the City to receive written quotes for construction projects less than $50,000. Staff sent the plans and specifications to three contractors on November 15, 2013 to get written quotations order to expedite the project. See the attached table summarizing the quotations.
The low quote was provided by Silver Star Construction Company, Inc. for $49,944.54 or approximately $18,571 less than the next lowest quote. The Engineer’s estimate for the project is $44,983.33 or 11% less than the lowest quote. Staff has done a comparative analysis of these quotes and believes this quote is competitive and represents a fair price. The Engineer’s estimate is based on a price history of six months to a year old. Silver Star has completed numerous street maintenance projects in the last ten (10) years along with constructing the Rock Creek Road Overpass and the I-35/Robinson Street Interchange projects. All work was completed on or ahead of schedule. The completed work met or exceeded the contract document requirements.
Funding for this Project is available from the Cedar Lane Widening Project Right of Way (account 050-9079-431.60-01; project BP0196).
RECOMMENDATION: Staff and our consultant have reviewed the quotes and recommend that the Drainage Channel Improvement Project be awarded to Silver Star, Inc. for $49,944.54.
