PUBLIC HEARING REGARDING APPROVAL OF CONTRACT K-1516-107 BY AND BETWEEN THE CITY OF NORMAN, OKLAHOMA, AND THE OKLAHOMA DEPARTMENT OF COMMERCE (ODOC) FOR THE COMMUNITY DEVELOPMENT BLOCK GRANT DISASTER RELIEF (CDBG-DR) PROGRAM FOR 2013 IN THE AMOUNT OF $5,004,821.

BACKGROUND:  In June 2014 the U.S. Department of Housing & Urban Development (HUD) released its allocations and program requirements for the Community Development Block Grant - Disaster Relief 2013 (CDBG-DR 13) Program, based on its estimate of critical unmet needs for repairing and rebuilding housing and infrastructure and economic revitalization in the most impacted areas, primarily using data provided by the Federal Emergency Management Agency (FEMA). Within these eligible areas, the Federal Register Notice required that a minimum of $41.2 million of the total State CDBG-DR funding must be expended in Cleveland and Creek Counties (exclusive of funds directly provided to the City of Moore). 

 

In July 2014 the City of Norman and Cleveland County submitted a joint preliminary scope of projects totaling over $49,000,000.  Subsequently, the Oklahoma Department of Commerce (ODOC) awarded projects to both the City of Norman ($12,054,090) and Cleveland County ($7,952,350). Both the City of Norman and Cleveland County are under contract for the design phases of these awards. In August 2015, the City of Norman and Cleveland County were notified by ODOC of the potential for additional CDBG-DR funding. The City of Norman and Cleveland County again collaborated to identify and submit potential projects.

 

On September 22, 2015 a Public Hearing was held before the Norman City Council in preparation of submittal of an application from the City of Norman. In addition a Public Hearing was held on October 28, 2015 at the cafeteria of Little Axe High School. In November 2015, both the City of Norman ($5,004,821) and Cleveland County ($2,607,239) submitted applications to ODOC for CDBG-DR funding. On January 25, 2016 both the City of Norman and Cleveland County were notified that these applications had been reviewed and were approved.

 

The awards as identified on the applications, is noted below:

 

City of Norman $4,859,050; $145,771 Administration

                     120th Avenue N.E. - From Tecumseh Road to Stella Road (4 Miles) - $3,939,240

                     Stella Road - 132nd Ave NE to 144th Ave NE (1 Mile) - $919,810

                     In addition the allowance of 3% of the total for Administration ($145,771) was awarded.

 

Cleveland County $2,531,300 Projects; $75,939 Administration

                     Harrah/Newalla Road - SE 89th Street south 1.25 Miles to meet limit of previous project $1,884,000

                     Cedar Lane - From 132nd Avenue S.E. to 156th Avenue S.E. (2 Miles) - $427,500

                     Post Oak Road - From 156th Avenue S.E. to Dead End (1 Mile) - $219,800

                     In addition the allowance of 3% of the total for Administration ($75,939) was awarded.

 

DISCUSSION:  The ODOC contract number is 16570 CDBG DR 13 (K-1516-107) in the amount of $5,004,821 and is attached.  As with the previous CDBG-DR award these funds are administered on a reimbursement basis. There is a two year time frame for the design and construction of these projects.

 

RECOMMENDATION:  Staff recommends conducting a public hearing as well as approval of Contract K-1516-107 with the Oklahoma Department of Commerce in the amount of $5,004,821.  Staff further recommends approval to appropriate the funds from Capital Fund Balance (050-0000-253.20-00) into the projects and accounts in the Community Development Fund as follows:

 

                     $3,939,240 into GC0067 in account 021-4000-463.61-01 (Construction)

                     $919,810 into GC0068 in account 021-4000-463.61-01 (Construction)

                     $145,771 into account 021-4000-463.20-01 (Salaries)

 

Upon receipt of the grant funds from the ODOC, staff recommends that they be recorded to the CDBG Fund and transferred to replenish the Capital Fund balance.
