CONTRACT NO. K-1213-90: A CONTRACT BY AND BETWEEN THE CITY OF NORMAN, OKLAHOMA, AND THE COMMUNITY AFTER SCHOOL PROGRAM FOR THE USE OF A PASSENGER BUS TO TRANSPORT CITY OF NORMAN FIREFIGHTER RECRUITS AND EQUIPMENT FOR TRAINING PURPOSES.

BACKGROUND: The City of Norman Fire Department currently has a recruit class of 20 candidates. The Fire Department is in need of a bus to transport recruits and equipment for training purposes because of the large size of the recruit class. The Community After School Program has a 72 passenger bus to transport students in their after school program. The Community After School Program has agreed to allow the Fire Department to rent their bus at no cost to transport recruits and equipment. However, the Community After School Program has asked the City of Norman to execute the attached Agreement prior to the Fire Department's use of the bus.
DISCUSSION: The Agreement will allow the Fire Department to rent the Community After School Program's bus to transport recruits and equipment at no cost. Under the terms of the attached Agreement, the Fire Department will be responsible for working with the Norman Public School Transportation Department to pick up and return the bus on a daily basis. The City of Norman will be responsible for ensuring proper use of the vehicle and compensating the Community After School Program for any damage to the vehicle caused by the City of Norman or the Fire Department. The City of Norman will be responsible for payment of any storage charges, parking charges, or fines in connection with the vehicle while it is being used by the Fire Department.
The City of Norman shall keep the vehicle in good working order, condition, and repair; however, reasonable wear and tear is permitted under the Agreement. The Community After School Program shall be notified of any damages or mechanical issues to the vehicle. If a mechanical error occurs the Agreement shall be terminated unless the City of Norman repairs the mechanical error. Prior to making any repairs the City of Norman shall get written approval from the Community After School Program to ensure reimbursement for expenses.
Before any driver from the City of Norman or the Fire Department drive the bus, they must have the required drivers licenses pursuant to Oklahoma Statutes. A member of the current recruit class possesses the necessary licensure and has agreed to be the driver.
Lastly, under the terms of the Agreement, the City agrees to indemnify the Community After School program for any loss or damage to the bus that occurs due to any act or omission of the City to the extent the City may be liable under the Oklahoma Governmental Tort Claims Act.
RECOMMENDATION: Based upon the above and foregoing discussion, it is the staff recommendation that Council approve and sign the Vehicle Rental Agreement if Council wishes to allow the City of Norman Fire Department to use the Community After School Program's bus to transport recruits and equipment for training purposes.
