CONSIDERATION OF BID NO. 1213-75, CONTRACT NO. K-1213-181 WITH RUDY CONSTRUCTION COMPANY IN THE AMOUNT OF $760,878.55; PERFORMANCE BOND NO. B-1213-78; STATUTORY BOND NO. B-1213-79; MAINTENANCE BOND NO. MB-1213-69, AND RESOLUTION NO. R-1213-112 FOR THE ROAD RECONSTRUCTION 2010 BOND PROGRAM (HAYES STREET FROM FLOOD AVENUE TO JAMES GARNER AVENUE AND IOWA STREET FROM BERRY ROAD TO BARBOUR AVENUE).

BACKGROUND: In the Norman General Obligation Bond Election of March 2, 2010, voters approved a 5-year, 4-phase program of Street Maintenance on neighborhood streets. The four phases include (1) Urban Asphalt Streets, (2) Urban Concrete Streets, (3) Rural Roads and (4) Road Reconstruction. The Road Reconstruction Program this year includes the complete removal and replacement of neighborhood streets at the following locations:
Hayes Street, Between Flood Avenue and James Garner Avenue (BP0312)
Iowa Street, Between Berry Road and Barbour Avenue (BP0342)
This program is funded in Road Re-Construction (account 050-9385-431.61-01; projects BP0312 and BP0342). Bid specifications and documents were advertised on April 9, 2013 and April 16, 2013. Nine (9) paving contractors received a set of documents. If approved, the base bid for this project will complete all FYE 2011 and all of the FYE 2012 locations for Road Reconstruction projects included in the 2010 Bond Election. Design is underway on the FYE 2013 Road Reconstruction project.
DISCUSSION: The bid opening was conducted on April 30, 2013, and four (4) contractors submitted bids. The lowest bid in the amount of $760,878.55 was submitted by Rudy Construction Company of Oklahoma City, OK. The low bid is below the engineer’s estimate of $805,957.36 by $45,078.81 (5.6% percent). The average of the four (4) bids is $876,763.96. Rudy Construction Company has previously worked for the City of Norman, and the firm received favorable references from other cities on similar projects, including the City of Oklahoma City.
If approved, construction will begin on these projects on May 29, 2013. Access to adjacent residential properties will be provided throughout the construction project. Neighborhood notification will be conducted prior to construction.
RECOMMENDATION 1: Staff has reviewed the bids and recommends that Bid 1213-75 for the Road Reconstruction 2010 Bond Program, be awarded to the low bidder, Rudy Construction Company, in the amount of $760,878.55.
RECOMMENDATION 2: Staff further recommends that, upon approval of Bid 1213-75, the following contract and bonds be approved:

Statutory Bond B-1213-79
Maintenance Bond MB-1213-69
RECOMMENDATION 3: Staff further recommends that, upon approval of Contract K_1213-181, that Resolution R-1213-112 be adopted authorizing Rudy Construction Company, as project agent.
