CONTRACT K-1617-64: A PROJECT AGREEMENT BY AND BETWEEN THE CITY OF  NORMAN, OKLAHOMA, AND THE OKLAHOMA DEPARTMENT OF TRANSPORTATION (ODOT) FOR FEDERAL AID PROJECT STP-214C(004)AG, JOB NO. 28903(04), FOR THE RESURFACING OF CONSTITUTION STREET, IMHOFF ROAD AND LINDSEY STREET IN THE AMOUNT OF $300,000 FOR THE CITY’S (20%) SHARE AND ADOPTION OF RESOLUTION R-1617-33.

BACKGROUND:  The 2012 - Moving Ahead for Progress in the 21st Century (MAP-21) federal transportation funding bill allocates approximately $21 million in federal funds per year for the implementation of eligible transportation improvements in the Oklahoma City metropolitan area. These pavement resurfacing projects are eligible for 80% federal funding.  The federal funds requested are given to the states through the Federal Highway Administration (FHWA) yearly.  These funds are granted through the Association of Central Oklahoma Governments (ACOG) in central Oklahoma.  Due to the federal funding, the construction projects are administered by the Oklahoma Department of Transportation (ODOT).

 

On November 22, 2011, City Council adopted Resolution R-1112-77 requesting federal funds for the construction of pavement overlays on various blocks of Lindsey Street, Constitution Street and Imhoff Road.  This project was submitted to ACOG with a request to include it in the Regional Transportation Improvement Plan (TIP). This request was approved in June of 2013 by both the Intermodal Technical and Policy Committees of ACOG.

 

On July 26, 2016, City Council approved Contract K-1617-34, a Right-of-Way and Utility Agreement with the Oklahoma Department of Transportation, for the resurfacing of Constitution Street, Imhoff Road and Lindsey Street Project.  This agreement requires the City to acquire rights-of-way and relocate utilities for this project at the City’s cost.  All rights-of-way have been acquired and all of the utility relocation is complete.

 

Proposed improvements for the roadway projects include:

 

Lindsey Street- Pickard Avenue to Jenkins Avenue

1.                     2-inch depth asphalt pavement mill and 2-inch asphalt overlay;

2.                     Pavement deep patching as needed;

3.                     ADA sidewalk ramp improvements;

4.                     New 4-foot wide sidewalk on the north side of Lindsey Street between Pickard Avenue and Elm Avenue;

5.                     New pavement markings;

6.                     Video detection system for existing traffic signals at Lindsey Street/Flood Avenue and Lindsey Street/Chautauqua Avenue intersections.

 

Constitution Street- Jenkins Avenue to Oak Tree Avenue

1.                     2-inch depth asphalt pavement mill and 2-inch asphalt overlay;

2.                     Pavement deep patching as needed;

3.                     ADA sidewalk ramp improvements;

4.                     New pavement markings.

 

Imhoff Road- east of Classen Boulevard to west of 24th Avenue SE

1.                     1 ¼” asphalt pavement mill and 1 ¼” asphalt overlay;

2.                     Pavement deep patching as needed;

3.                     New pavement markings.

 

Final design plans were submitted to ODOT in June 2016 and have been reviewed and accepted.

 

DISCUSSION:  The final milestone for this project is for ODOT to accept competitive bids and begin construction.  Prior to the bid opening, ODOT requires the City of Norman to enter into a project maintenance agreement and to adopt it by Resolution.  ODOT has requested the City approve the attached agreement that addresses the responsibilities of the City of Norman and ODOT. Staff has reviewed and recommends approval of the project agreement and resolution. 

 

In summary, the City’s responsibilities are:

                     Prepare plans for construction in conformance with ODOT 2009 Standard Specifications;

                     Provide necessary rights-of-way to construct the project and relocate any utilities;

                     Maintain the traffic signal equipment after construction;

                     Certify the project will comply with the Americans with Disabilities Act (ADA);

                     Comply with environmental requirements;

                     Maintain the roadway and all drainage systems and facilities after construction;

                     Ensure permanent rights-of-way are free of any encroachments;

                     Maintain lighting and lighting systems.

 

In summary, ODOT’s responsibilities are:

                     File jointly with the contractor the Notice of Intent for a general construction storm water permit with the EPA which authorizes storm water discharges associated with construction activities;

                     Advertise and let the construction contract for this project;

                     Construct the project in accordance with the plans;

                     Provide competent supervision of the construction.

 

The construction project is funded 80% by ODOT and 20% by local funds.  ODOT has billed the City for the local matching share.  Based on the latest engineer’s estimate, the total construction cost is $1,500,000 with ODOT’s estimated share at $1,200,000 and the local match is $300,000.  The City’s share of these funds must accompany this agreement and put on account at ODOT.  ODOT will use these funds to pay Norman’s share on invoices.  After the construction is complete, any unused funds are returned to the City.  Should the City’s share exceed $300,000, additional funds from the City will be required.

 

Funding for this project is from the FYE 2017 Capital Fund.  Currently, there is $498,866 available in Pavements Overlays Citywide, Construction (account 050-9511-431.61-01; project TR0055). 

 

A bid opening for this project has been scheduled by ODOT on November 17, 2016. The estimated start of construction is March 2017 for Constitution Street and Imhoff Road.  Construction on Lindsey Street will start after May 15, 2017 to allow for the completion of the spring semester at the University of Oklahoma.  Construction is anticipated to be complete by July 2017. 

 

RECOMMENDATION NO. 1Staff recommends approval of Contract K-1617-64 with ODOT.

 

RECOMMENDATION NO. 2Staff further recommends approval of Resolution R-1617-33 adopting Contract K-1617-64, and if approved, authorize the execution thereof.
