CHANGE ORDER NO. ONE TO CONTRACT K-1314-101: BY AND BETWEEN THE CITY OF NORMAN, OKLAHOMA, AND SILVER STAR CONSTRUCTION COMPANY, INC., INCREASING THE CONTRACT AMOUNT BY $1,261.10 FOR A REVISED CONTRACT PRICE OF $51,205.64 FOR THE MIKE DESKIN TRUST DRAINAGE CHANNEL IMPROVEMENT PROJECT FOR THE CEDAR LANE WIDENING PROJECT AND FINAL ACCEPTANCE OF THE PROJECT.

BACKGROUND: On February 8, 2011, City Council approved engineering services Contract K-1011-135 with Cardinal Engineering Inc. for the design of the Cedar Lane Road Widening Project in the amount of $350,630 or 3.5% of the total estimated project cost. The Cedar Lane Road Widening Project involves the construction of a new four-lane roadway that will include five foot bike lanes on each side of the road. The project will also include improvements to 12th Avenue SE and 24th Avenue SE as they approach Cedar Lane Road, improvements to the BNSF railroad crossing and resurfacing of U.S. Highway 77 (Classen Boulevard) on the north and south sides of Cedar Lane Road. Signalization of the 12th Avenue SE and Cedar Lane Road intersection will also help relieve traffic congestion at peak travel times during the day.
On November 22, 2011, the Norman City Council approved programming Resolution R-1112-60 requesting federal funds to widen Cedar Lane Road. This resolution states the City's commitment to adhere to the terms and conditions of a federally funded project including engineering design, acquisition of all necessary rights-of-way and relocation of utilities and encroachments at 100% the City's cost. In return, the Association of Central Oklahoma Governments (ACOG), through the Oklahoma Department of Transportation (ODOT), agrees to provide 80% of the construction cost, estimated at $6,231,280, and administration of the construction with the matching share (20%) from the City of Norman.
On August 28, 2012, the citizens of Norman voted in favor of a Bond Issue to finance the local share of eight transportation/storm water improvement projects. One of the eight 2012 bond projects is the Cedar Lane Road Widening Project. On April 23, 2013, City Council approved Contract K-1213-183, a Right-of-Way and Utility Agreement with the Oklahoma Department of Transportation, for the construction of the Cedar Lane Road Widening Project. This agreement requires the City to acquire rights-of-way and relocate utilities for this project. All right-of-way has been acquired and all utilities have been relocated.
On December 10, 2013, City Council approved Contract K-1314-101, a Construction Contract with Silver Star Construction Company for the improvements to the drainage channel related to the Cedar Lane Road Widening Project for $49,944.54.
On March 20, 2014, ODOT accepted bids for the Cedar Lane widening project. Three contractors submitted bids and on April 7, 2014, ODOT awarded the contract to Duit Construction Company for $7,746,686.57. Construction of the roadway widening project began in June, 2014 with an expected completion date in May 2015.
DISCUSSION: Improvements to the drainage channel were necessary to help convey storm water runoff from the widened Cedar Lane Road through an existing residential parcel, in a public drainage easement. As a part of the Right-of-Way Agreement with the property owner, the City agreed to complete the drainage channel improvements prior to the roadway widening project. The improvements included widening the channel to create a shallow slope, replacing trees removed from the channel, adding decorative rocks and adding larger, more efficient pipe culverts under the property owner's driveway.
The Drainage Channel Improvement Project began construction in January 2014 and was complete in August 2014. There was an overrun in sod due to a calculation error made by the design engineer. The sod overrun cost $1,261.10, resulting in a change order increasing the contract to $51,205.64 or a 2.5% increase. All other quantities match plan quantities. Funds are available in the project account (050-9079-431.60-01; BP0196) for this change order.
RECOMMENDATION No. 1: Staff recommends approval of Change Order No. 1 increasing Contract K-1314-101 with Silver Star Construction Company by $1,261.10.
RECOMMENDATION No. 2: Staff further recommends final acceptance of the Drainage Channel Improvement Project, Contract K-1314-101 with Silver Star Construction Company.
