CHANGE ORDER NO. TWO TO CONTRACT NO. K-1213-129: BY AND BETWEEN THE NORMAN UTILITIES AUTHORITY AND BRB CONTRACTORS, INC., EXTENDING THE CONTRACT BY 124 CALENDAR DAYS FOR THE NORMAN RAW WATER LINE PROJECT, PHASE 1 (VAULTS), AND FINAL ACCEPTANCE OF THE PROJECT.

BACKGROUND: BRB Contractors, Inc. (BRB) was awarded Contract No. K-1213-129 on February 12, 2013 to complete the vaults for the Raw Water Line project. BRB completed the job that was abandoned by a former contractor in the middle of the job. Staff issued a notice to proceed for the Raw Water Line Phase I Vaults Project on February 27, 2013.
On May 14, 2013, the NUA approved Change Order 1 increasing the contract time by 64 calendar days for a revised completion date of July 1, 2013; the contract amount was not impacted by this change order.
BRB worked closely with staff coordinating shut-downs allowing the inter-connections between the existing concrete raw water line and the new 48-inch FRP raw water line at the vaults constructed at 60th Avenue NE and at the Water Treatment Plant (WTP). As a result, these crucial connections were made within two 10-hour windows without disruption of water service to our citizens.
Once the vaults were complete and connections made, BRB attempted to pressure test the 48-inch raw water line installed by the former contractor. Unfortunately, leaks were detected as revealed by pressure loss. One large leak was located and repairs were made to the raw water line under the allowance contained in the existing BRB contract. Additional pressure testing indicates that another small leak exists; however, project funding does not allow BRB to continue searching for it. Staff believes water from the small leak will eventually rise to the surface allowing final repairs to be made at that time.
DISCUSSION: Our consultant, Garver, has prepared Final Change Order #2 to Contract No. K-1213-129 between NUA and BRB. There is no change to the contract amount but an additional 114 calendar day time extension is recommended to coincide the actual completion date of October 23, 2013. The majority of the days were consumed fabricating a special coupling to allow the interconnection to be completed and for attempting to find leaks in the raw water line. Additional time was consumed painting a vent structure, not properly coated by the previous contractor, and for repairing citizens’ yards that had settled from previous work.
Therefore, the change order will extend the completion date to October 23, 2013 while the contract price will remain the same. Currently, BRB has been paid $680,816.55 of the original $788,505. Final payment in the amount of $103,206.45 is due to BRB.
RECOMMENDATION: Staff recommends approval of Final Change Order No. 2 to Contract No. K-1213-129 with BRB Contractors, Inc. increasing the contract time by 114 calendar days and final acceptance of Norman Raw Water Line, Phase I Vaults project and approval to make final payment to BRB Contractors, Inc.
