CONSIDERATION OF APPROVAL, REJECTION, AMENDMENT, AND/OR POSTPONEMENT OF A FINAL SITE DEVELOPMENT PLAN AND FINAL PLAT FOR VARENNA LANDING ADDITION, SECTION 1, A PLANNED UNIT DEVELOPMENT, AND ACCEPTANCE OF PUBLIC DEDICATIONS CONTAINED THEREIN.

BACKGROUNDThis item is a final site development plan/final plat for Varenna Landing Addition, Section 1, a Planned Unit Development and is generally located on the north side of East Lindsey Street approximately 1,400 feet east of 24th Avenue S.E.  Varenna Landing Addition, Section 1, a Planned Unit Development, is a 12.58-acre subdivision consisting of 51 single-family residential lots, a common open space property that contains Water Quality Protection Zone (WQPZ) and a privately maintained detention facility.  The City Legal Department staff has reviewed covenants that address the WQPZ and common areas.

 

City Council, at its meeting of May 15, 1984, adopted Ordinance No. O-8384-109 placing this property in the R-1, Single Family Dwelling District, with permissive use for a Planned Unit Development.  City Council, at its meeting of June 25, 2019, approved the preliminary plat for Varenna Landing Addition, a Planned Unit Development.

 

The Norman Development Committee, on April 8, 2021, approved the program of public improvements, final site development plan/final plat and recommended that the final site development plan and final plat for Varenna Landing, Section 1, a Planned Unit Development, be submitted to City Council for consideration.

 

DISCUSSION: Construction plans have been approved for the required public improvements for this development.  Some of the public improvements are under construction.  These improvements consist of water mains with fire hydrants, sanitary sewer mains, storm drainage, street paving, sidewalks and fencing adjacent to Lindsey Street.  Stormwater runoff will be conveyed to a proposed privately maintained detention facility.  It has been determined there are several conflicts with existing utilities regarding the construction of Lindsey Street paving.  The developer/contractor is working with the utility companies to lower their lines within these conflicts.  These utilities will either be relocated or lowered.  The franchised utility companies will not be able to accomplish this work for up to six months.  The improvements do not conflict with the entrance to the new development.  The Norman Development Committee accepted Subdivision Bond B-2021-79 and Irrevocable Letter of Credit 30-503 securing paving improvements for Lindsey Street.  This will allow the final plat to be filed of record upon the completion of the remaining improvements.

 

Park land requirements have been satisfied.

 

STAFF RECOMMENDATION: The final plat is consistent with the preliminary plat.  Based upon the above information, staff recommends acceptance of the public dedications, approval of the final site development plan and final plat and filing of the final site development plan/final plat subject to completion of public improvements or bonds/cash sureties securing public improvements.  This action authorizes the Mayor to sing the final plat and bonds.
