AMENDMENT NO. FOUR TO CONTRACT NO. K-0910-185: BY AND BETWEEN THE NORMAN UTILITIES AUTHORITY AND THE ASSOCIATION OF CENTRAL OKLAHOMA GOVERNMENTS (ACOG) EXTENDING THE CONTRACT UNTIL JUNE 30, 2015, FOR PHASE 2 OF THE CANADIAN RIVER WASTELOAD ALLOCATION STUDY.

BACKGROUND: On June 22, 2010, the Norman Utilities Authority (NUA) approved Contract No. K-0910-185 with the Association of Central Oklahoma Governments (ACOG), to coordinate a study of the Canadian River as required by the Oklahoma Department of Environmental Quality (ODEQ). NUA approved Amendment One, extending the contract through June 30, 2012 on February 14, 2012, Amendment Two, extending the contract through June 30, 2013 on July 24, 2012, and Amendment Three, extending the contract through June 30, 2014 on July 23, 2013.
The NUA has partnered, through ACOG, with other communities which discharge to the Canadian River to study impacts on the river water quality. ACOG selected a consultant who completed a sampling and testing plan, the Quality Assurance Project Plan (QAPP). The QAPP was approved by Environmental Protection Agency Region 6 (EPA6) in Dallas on March 25, 2010, which completed Phase 1.
Phase 2 began with sampling and testing on July 1, 2010. An interim report of modeling progress was submitted to ODEQ during October 2011, then to EPA6 in December 2011. Since that time, numerous modeling scenarios were developed and simulated via the ODEQ/EPA6 approved model. The most recent and presumed Final Projection Simulations were received on July 1, 2014 and all parties have been asked to concur with the results. For the NUA, the most stringent summer months discharge limitations are proposed to be 6.0 mg/l CBOD, 1.3 mg/l Ammonia and 6.5 mg/l dissolved oxygen as compared to the current summer limits of 13 mg/l CBOD, 4.1 mg/l Ammonia and 5.0 mg/l dissolved oxygen.
In the near future, ODEQ will conduct public hearings for the proposed revisions to the Canadian River Water Quality Management Plan for all impacted dischargers. After the public hearings, public comment, if any, will be considered and the results submitted to EPA6 for final approval.
DESCRIPTION: This item represents ACOG’s request for renewal for Fiscal Year Ending (FYE) 2015, or through June 30, 2015. The only change by Amendment 4 is the time extension.
RECOMMENDATION: Recommend NUA approve Amendment No. 4 to Contract No. K-0910-185; and authorize the execution thereof.
