CONTRACT NO. K-1314-105: A CONTRACT BY AND BETWEEN THE CITY OF NORMAN, OKLAHOMA, AND DUKE CONOCO PHILLIPS MIDSTREAM (DCP) IN THE AMOUNT OF $76,785 FOR THE RELOCATION OF GAS PIPE LINE.

BACKGROUND: On February 8, 2011, City Council approved engineering services Contract No. K-1011-135 with Cardinal Engineering Inc. for the design of the Cedar Lane Road Widening Project for $350,630 or 3.5% of the total estimated project cost. The Cedar Lane Road Widening Project involves the construction of a new four-lane roadway that will include five-foot wide bike lines on each side of the road. The project will also include improvements to 12th Avenue SE and 24th Avenue SE as they approach Cedar Lane Road, improve the BNSF railroad crossing and resurface U.S. Highway 77 on the north and south sides of Cedar Lane Road. Signalization of the 12th Avenue SE and Cedar Lane Road intersection will also help relieve traffic congestion at peak travel times during the day.
On November 22, 2011, the Norman City Council approved programming Resolution No. R-1112-60 requesting federal funds to widen Cedar Lane Road. This resolution states the City’s commitment to adhere to the terms and conditions of a federally funded project including engineering design, acquisition of all necessary rights-of-way and relocation of utilities and encroachments at 100% the City’s cost. In return, the Association of Central Oklahoma Governments (ACOG), through the Oklahoma Department of Transportation (ODOT), agrees to provide 80% of the construction cost estimated at $6,231,280, and administration of the construction with the 20% matching share from the City of Norman.
On August 28, 2012, the citizens of Norman voted in favor of a Bond Issue to finance the local share of eight transportation/storm water improvement projects. One of the eight 2012 bond projects is the Cedar Lane Road Widening Project. See the attached location map showing the project boundaries.
On April 23, 2013, City Council approved Contract No. K-1213-183, a Right-of-Way and Utility Agreement with ODOT for the construction of the Cedar Lane Road Widening Project. This agreement requires the City to acquire right-of-way and relocate utilities for this project. Currently, all right-of-way has been acquired and 90% of the utility companies have relocated.
On December 10, 2013, City Council approved Contract No. K-1314-89, a contract with Central Contracting Services, Inc., to relocate the waterline within the limits of the Cedar Lane Road Widening Project. The waterline relocation was completed on February 15, 2014.
On February 11, 2014, City Council approved Contract No. K-1314-113, a contract with ODOT and Contract No. K-1314-117, a three party agreement between the City of Norman, ODOT, and the Burlington Northern Santa Fe Railroad Company. The approval of both contracts allows the project to be bid.
DISCUSSION: During the preparation work for the utility relocations,all utilities in the corridor were notified. Duke Conoco Phillips Midstream (DCP) was provided plans in late November 2012. All identified facilities, including DCP, were added to the plans for design of the project. In December 2013, a previously unidentified DCP pipeline was discovered by staff during the relocation of the water line along Cedar Lane Road. Staff then determined the pipeline would conflict with the proposed roadway improvements. Staff began negotiations with DCP to relocate their line in their existing easement soon after the identification of the pipeline.
DCP is requesting the City execute the attached relocation agreement for the relocation of the 4-inch gas pipeline for the Cedar Lane Road Widening Project. The DCP pipeline is located in a private easement; therefore the City must reimburse DCP for their expenses. The relocation requires DCP to lower a portion of the pipeline which conflicts with the future storm water pipeline crossing Cedar Lane Road. The cost to relocate DCP’s pipeline is estimated at $76,785. However, the City will only pay the actual documented relocation cost upon completion. If this agreement is approved, all work associated with DCP’s relocation should be completed no later than March 20, 2014, allowing the Cedar Lane Road Widening Project to remain on the current schedule. ODOT accepted bids for the project on February 27, 2014 and will award the contract on March 20, 2014. Construction of the Cedar Lane Road Widening Project will begin in June, 2014 with completion anticipated by May 2015.
Funds are available to cover the relocation costs in the project Construction account (account 050-9079-431.61-01; project BP0196).
RECOMMENDATION: Staff recommends approval of Contract No. K-1314-105 with Duke Conoco Phillips Midstream for the relocation of DCP’s 4-inch gas pipeline.
