CONSIDERATION OF BID 1617-9; CONTRACT K-1617-3 BY AND BETWEEN THE NORMAN TAX INCREMENT FINANCE AUTHORITY AND RDNJ, L.L.C., D/B/A A-TECH PAVING IN THE AMOUNT OF $811,315.50; PERFORMANCE BOND B-1617-5; STATUTORY BOND B-1617-6, AND MAINTENANCE BOND MB-1617-3 FOR THE 24TH AVENUE AND RADIUS WAY TRAFFIC SIGNAL AND INTERSECTION IMPROVEMENT PROJECT.

BACKGROUND:  On August 8, 2006, City Council approved Contract K-0607-45 by and between the City of Norman and the University Town Center L.L.C., regarding Development Agreement No. 1 for the initial project activities associated with the traffic improvements needed to mitigate the additional traffic generated by the University North Park (UNP) development.  The attached Exhibit A was included in Development Agreement No. 1 and includes the list of required traffic/transportation improvements for the UNP Development.  Among the projects listed in Exhibit “A” are five intersections on 24th Avenue NW.  Development Agreement No. 1 addresses the funding of these projects through the University North Park Tax Increment Finance Authority (NTIFA).

 

The City has constructed four of the five intersections along 24th Avenue NW as listed below:

 

                     Mount Williams Drive

                     Conference Center Drive

                     Legacy Park Drive

                     Corporate Center Drive

 

The fifth and final intersection under that agreement is 24th Avenue NW and Radius Way, which is located half way between Rock Creek Road and Corporate Center Drive (see the project location map).  This intersection will provide access to a multi-family residential development on the east side of 24th Avenue NW and future development on the west side.  The intersection will include left turn bays for northbound and southbound traffic, decorative pavement and decorative traffic signal equipment. On November 24, 2015, the NTIFA/Council approved Contract K-1516-78 with SMC Consulting Engineers for the design of the intersection.

 

DISCUSSION:  Bid documents and specifications for constructing the intersection project were advertised according to State Law.  Two (2) potential bidders purchased plans and specifications and two (2) bids were received on September 29, 2016.

 

The low bidder was RDNJ LLC dba A-Tech Paving for $811,342.50, approximately $38,507.50 less than the next lowest bidder.  The Engineer’s estimate for the project is $899,789.99.  The City’s design consultant, SMC, did a comparative analysis of the bids and believes this bid is competitive and a fair bid.  The construction of the intersection will begin on January 9, 2017 and must be completed by April 10, 2017.  This completion date is concurrent or ahead of schedule relative to completion of the adjacent, new apartment complex called 24th Avenue Apartments.

 

A-Tech has completed several roadway projects in Norman. These road projects encompassed Nebraska Street from Flood Avenue to University Boulevard, and Mosier Street from Carter Avenue to Cockrell Avenue. A-Tech was recently awarded two different projects as part of the Urban Concrete Pavement Rehabilitation 2010 Bond Project FYE 2015, 1) Main Street from Park Drive to Berry Road and 2) Comanche Street from Porter Avenue to Peters Avenue and Lahoma Avenue to Chautauqua Avenue.

 

The City’s design consultant checked their references and found that their work has met or exceeded the requirements listed in the contract documents.

 

Funding for this intersection project is in the University North Park TIF Fund, Project UT0012, 24th NW and Radius Way, Construction (057-9403-431.61-01) which currently contains $849,342.50 to cover the cost of the proposed contract.  In addition to the cost of construction, an estimated $5,000 will be required to pay for the construction testing services.  Professional Service Industries, Inc. of Oklahoma City, Oklahoma will provide material testing services for this project as part of their annual contract with the City.

 

RECOMMENDATION NO. 1:  Staff and our consultant have reviewed the bids and recommend that Bid 1617-9 for the 24th Avenue NW and Radius Way Traffic Signal and Intersection Improvement Project be awarded to the low bidder, RDNJ LLC dba A-Tech Paving.

 

RECOMMENDATION NO. 2:  Staff further recommends that the following contract and bonds be approved:

Performance Bond B-1617-5

Statutory Bond B-1617-6

Maintenance Bond MB-1617-3
