AMENDMENT NO. ONE TO CONTRACT K-1718-123: BY AND BETWEEN THE CITY OF NORMAN, OKLAHOMA, AND HOWELL AND VANCUREN, INC., INCREASING THE CONTRACT AMOUNT BY $30,600 FOR A REVISED CONTRACT AMOUNT OF $480,600 PLUS $8,235 FOR REIMBURSABLE EXPENSES TO PROVIDE ADDITIONAL DESIGN SERVICES FOR THE PREPARATION OF CONSTRUCTION DOCUMENTS, BIDDING SERVICES AND CONSTRUCTION SUPERVISION FOR THE NORMAN FORWARD PHASE I RUBY GRANT PARK PROJECT AND BUDGET TRANSFERS BETWEEN PROJECT ACCOUNTS.

BACKGROUND: On June 26, 2018, The Norman City Council approved Contract K-1920-40 with Howell and VanCuren, Inc. in the amount of $450,000 plus reimbursable expenses for Design Services for the Norman Forward Phase I Ruby Grant Park Project.
Since contract approval, Howell and VanCuren, Inc. has completed all design and construction documents for work that can be supported by the current funding available for this project. Crossland Construction Company was hired by the City of Norman as the Construction Manager at Risk to build the project. Construction is underway and currently scheduled for completion in November 2020. On February 12, 2020, the Ruby Grant Park Ad Hoc Group voted to request that City Council seek additional funding to complete the full project as originally proposed.
DISCUSSION: Howell and VanCuren Inc. has proposed additional design fees of $30,600 and $8,235 for reimbursable expenses (see Contract Amendment No. 1) to provide additional services for the Norman Forward Phase I Ruby Grant Park Project. The additional design fees will include all services needed to complete construction of the project as originally proposed, provided additional funding is approved. Should additional funding not be acquired, the completed construction documents will be held until adequate funding is available to complete the project. A bond election analysis provided by ADG, our program managers for this project, is attached for additional information.
Funds are available for this project in the NORMAN FORWARD Fund, Ruby Grant Park Phase I, Design (account 51793325-46201; project NFP105).
RECOMMENDATION NO 1: Staff recommends approval of Amendment No. 1 to Contract K-1718-123 with Howell and VanCuren, Inc. in the amount of $30,600 plus $8,235 for reimbursable expenses for Professional Architectural Design Services for the Phase I Ruby Grant Park Project.
RECOMMENDATION NO 2: Staff further recommends approval of a transfer of funds in the amount of $30,600 plus $8,235 for reimbursable expenses for a total of $38,835 from the NORMAN FORWARD Fund, Ruby Grant Park Phase I, Construction (account 51793325-46101; project NFP105) to Design (account 51793325-46201; project NFP105).
