BACKGROUND: For several years, the Cleveland County Sheriff's Office has provided jail services for the prisoners taken into custody by the Norman Police Department for municipal charges.  Prior to 1998, the City of Norman had a verbal agreement with the Cleveland County Sheriff's Office to provide jail services for $25 per day per prisoner.  On June 23, 1998, the Council approved Contract No. K-9798-149 between the City of Norman and the Cleveland County Sheriff's Office and the Board of Commissioners of Cleveland County for jail services for $30 per day per prisoner.  On July 25, 2006, the Council approved Contract No. K-0607-28 raising the jail services fee from $30 to $35.  On October 28, 2008, the Council approved Contract No. K-0809-66 at the existing $35 per day rate.  The Contract term ended on June 30, 2009.  From that date until March, 2010, the Sheriff's Department continued to deliver and accept prisoners under the terms of the expired agreement and negotiated with the Sheriff regarding a rate increase based on future jail services, including the construction of a new jail facility.
      
On March 23, 2010, the City Attorney's Office and the Police Department presented Contract No. K-0910-69, which included increasing the jail services costs from $35 per day to $45 per day.  The Sheriff provided documentation of the actual costs to operate the County Jail and requested the new rate become effective March 1, 2010.  The City Council approved the new rate.
 
The new Cleveland County Justice Center was constructed and began operations in early 2012.  The Sheriff's Office advised the City it would reassess the cost of incarceration at the new facility for a period of at least one year to determine if a future rate increase was appropriate.  The Jail Services Agreement, along with attachments, being presented at this time, addresses a rate increase from $45 to $48 per day.
 
DESCRIPTION: On July 2, 2013, Cleveland County Undersheriff Rhett Burnett notified the Norman Police Department, along with the cities of Moore, Noble and Lexington, of a proposed increase to the cost of incarceration from $45 to $48 per day.  Attached is the July 2, 2013, letter and an expense breakdown from February 11, 2012 to February 20, 2013, detailing the formula used to determine the proposed increase.  Based on a review of the three prior years of incarceration costs, the financial impact of the proposed rate increase is expected to increase from $18,500 to $21,500 annually.
 
Although the City of Norman pays the County for housing City of Norman prisoners, Oklahoma State statutes allow cities to collect from the prisoners the cost of their incarceration.  These costs are collected as part of the costs in Municipal Court and deposited in the General Fund.   The reimbursement amount from prisoners helps offset the cost to the City for housing prisoners.
 
RECOMMENDATION: It is recommended that Contract No. K-1314-37 between the Cleveland County Sheriff's Department and the City of Norman for the provision of detention/incarceration services be approved.  Funds in the amount of $238,000 are available in Prisoner Care (account 010-6015-421.41-11).
