Title
RESOLUTION NO. R-1415-54:  A RESOLUTION OF THE COUNCIL OF THE CITY OF NORMAN, OKLAHOMA, PROGRAMMING FEDERAL SURFACE TRANSPORTATION URBANIZED AREA (STP-UZA) FUNDS FOR ROADWAY MODIFICATIONS AND A NEW TRAFFIC SIGNAL AT THE INTERSECTION OF PORTER AVENUE AND ACRES STREET IN NORMAN.

Body
BACKGROUND:  The 2012 - Moving Ahead for Progress in the 21st Century (MAP-21) federal transportation funding bill allocates approximately $21 Million in Federal funds per year for the implementation of eligible transportation improvements in the Oklahoma City metropolitan area. Ten percent of this appropriation is used to fund safety projects at 100% of their construction cost.

Every year, the Association of Central Oklahoma Governments (ACOG) coordinates a regional evaluation process that identifies transportation improvements eligible for federal funding. Individual projects are rated and compared to one another using a pre-established criterion. The process ends with the formulation of the region's transportation improvement program and the decision to use federal funds to pay for a significant portion of the cost of the higher priority projects.

DISCUSSION:  On December 15, 2014, staff will submit 23 projects for consideration in the formulation of ACOG's Three-Year Transportation Improvement Program Plan Update. One of the requirements for project consideration is that interested cities submit programming resolutions for each individual project. In years past, Council has adopted resolutions for 20 of the 23 projects. The three projects that need programming resolutions in order to be considered in the plan update are:

Main Street Traffic Signal Interconnect, between 24th Avenue West and 36th Avenue West (100% Safety) (Resolution R-1415-55)
Main Street Traffic Signal Interconnect, between 24th Avenue West and University Boulevard (100% Safety) (Resolution R-1415-56)
Robinson Street widening and reconstruction, between Brookhaven Creek and Interstate 35 (Resolution No. R-1415-57)

Additionally, in an effort to maximize the amount of federal funds that can be used for the construction of the Lindsey Street Bond project, between 24th Avenue SW and west of Pickard Avenue, staff will be submitting the project as two phases. Phase 1 includes the segment between 24th Avenue SW and Berry Road and will continue to be funded from the adopted federal fiscal year 2015 plan, and Phase 2, which includes the segment between Berry Road and west of Pickard Avenue, will be funded as part of federal fiscal year 2016. For practical purposes, both projects will be under construction at the same time. This strategy gives the City an opportunity to lever an additional $3 million in federal funds for the construction of the overall project. To move forward, it is necessary for City Council to adopt programming resolutions for the following projects:

Phase 1 - Lindsey Street widening and reconstruction, from 24th Avenue SW to Berry Road (Resolution No. R-1415-52

Phase 2 - Lindsey Street widening and reconstruction, from Berry Road to west of Pickard Avenue (Resolution No. R-1415-53

Finally, in order to advance the design of projects scheduled beyond federal fiscal year 2018, City Council also needs to adopt the following project programming resolution:

Porter Avenue and Acres Street traffic signal and intersection widening (Resolution R-1415-54).

Four of the projects on the Federal Fiscal Years 2016-2018 list have not been programmed by the Oklahoma Department of Transportation. In order for this to happen and for these projects to be considered for funding, City Council needs to adopt the corresponding programming resolutions. In the resolutions, the City agrees to the terms and conditions of a federally funded project by stating its willingness to assume the responsibility for the preparation of engineering plans, the purchase of any additional right-of-way, the relocation of public utilities and funding of the 20% local share of the construction cost.

RECOMMENDATION:  Staff recommends approval of Resolution Nos. R-1415-52 thru 57 for various federally funded projects.
