CONTRACT NO. K-1213-74: A MAINTENANCE AGREEMENT BY AND BETWEEN THE CITY OF NORMAN, OKLAHOMA, AND THE OKLAHOMA DEPARTMENT OF TRANSPORTATION (ODOT) FOR FEDERAL-AID PROJECT NO. STPG-114B(302)AG, JOB NO. 29010(04) FOR THE JENKINS AVENUE ROADWAY LIGHTING UPGRADE PROJECT AND ADOPTION OF RESOLUTION NO. R-1213-48.

BACKGROUND: The 2005 - Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) allocates approximately $15 Million in Federal funds per year for the implementation of eligible transportation improvements in the Oklahoma City metropolitan area. Ten percent of this appropriation is used to fund safety projects at 100% of their construction cost. Roadway lighting improvements along federal functionally classified roads are eligible for this level of funding.
On June 14, 2011, City Council approved Resolution R-1011-129 which was forwarded to both the Association of Central Oklahoma Governments (ACOG) and the Oklahoma Department of Transportation (ODOT) requesting federal funds to pay for 100% of the construction cost. In the resolution the City agrees to the terms and conditions of a federally funded project by stating its willingness to assume the responsibility for the preparation of engineering plans, the purchase of any additional right-of-way, the relocation of public utilities and funding of the local share of the construction cost, which normally is 20% but for this safety project will be 0%. The project was submitted for consideration and is currently included in the Association of Central Oklahoma Governments' (ACOG) 2012 Regional Transportation Improvement Plan (TIP).
On January 10, 2012, City Council approved Amendment No. 1 to Contract No. K-1011-84 with H.W. Lochner for design and preparation of construction plans. The $20,000 fee for these services is being funded jointly by the University of Oklahoma and the City of Norman, with each party contributing 50% of the cost. Final plans have been completed and were submitted to ODOT with a request to include the project in their November 2012 bid opening. Construction is anticipated to begin in the spring of 2013 with completion of the work in early summer of the same year.
This project will replace the antiquated street lighting system along Jenkins Avenue, starting north of State Highway 9 and ending at Constitution Street (see attached map). The new system will feature "green" technology with the use of light-emitting diode (LED) lamps. The upgrade is anticipated to save the City approximately $7,000 per year in operating cost.
Design standards, which are similar to those being used in the Main Street Roadway Lighting Upgrade project currently under construction, were developed in cooperation with Oklahoma Gas and Electric (OG&E) staff, who has agreed to provide future maintenance of the system as part of the City's current street lighting contract.
Final plans were completed and have been submitted to the Oklahoma Department of Transportation (ODOT) with a request to include the project in their November 15, 2012 bid opening. Construction is anticipated to begin in late winter/early spring of 2013 with completion of the work expected in May of 2013. The estimated construction cost of $377,400 will be funded with 100% federal funds as a safety improvement project.
DISCUSSION: The Oklahoma Department of Transportation requires the City to execute a project agreement and to adopt it by resolution before letting the project to contract. The agreement addresses the responsibilities of the City and the Department during and after the construction of the project. The execution of three original documents is required. Both the resolution and agreement have been reviewed by staff and approved by the City Attorney.
The total project implementation cost would be as presented in Attachment No. 1.
RECOMMENDATION: Staff recommends approval of Contract No. K-1213-74 and Resolution R-1213-48 with ODOT for the Jenkins Avenue Continuous Roadway Lighting Upgrade project.
